<br />notice of such tender date and which shall henceforth be deemed the Commencement
<br />Date of this Lease. The expiration date of the term of this Lease shall not be extended by
<br />virtue of delay in Landlord's delivery of the Premises to Tenant. Subsequent renewal
<br />terms shall be for a period of twelve (12) months from the Commencement Date.
<br />6. USE OF PREMISES.
<br />(a) Tenant shall use and occupy the Premises throughout the term of
<br />the Lease solely for the purpose of operating and maintaining an ambulance service to
<br />provide emergency and non-emergency medical services for the people living in Lee
<br />County and adjacent areas. Any other use of the premises without Landlord's approval
<br />shall constitute a breach of this Lease. Tenant recognizes that these restrictions on the
<br />use of the Premises is a material consideration for Landlord to enter into this Lease.
<br />(b) Tenant shall comply with all laws, ordinances, rules, regulations
<br />and codes of all municipal, county, state, and federal authorities pertaining to the use and
<br />occupation of the Premises. Tenant shall neither use nor occupy the Premises or any part
<br />thereof for any illegal, unlawful, dangerous, or hazardous purpose, nor shall it conduct its
<br />operations in a manner which would constitute a new nuisance of any kind.
<br />7. ENVIRONMENTAL COMPLIANCE/HAZARDOUS MATERIALS.
<br />(a) Definitions. "Hazardous Materials" shall mean any material,
<br />substance or waste that is or has the characteristic of being hazardous, toxic, ignitable,
<br />reactive or corrosive, including, without limitation, petroleum, PCB's, asbestos, materials
<br />known to cause cancer or reproductive problems and those materials, substances and/or
<br />waste, including infectious waste, medical waste, and potential infectious biomedical
<br />waste, which are or later become regulated by any local governmental authority, the state
<br />in which the Premises are located or the United States Government, including, but not
<br />limited to, substances defined as "Hazardous Substances," "Hazardous Materials,"
<br />"Toxic Substances," or "Hazardous Waste" in the Comprehensive Environmental
<br />Response, Compensation, and Liability Act of 1980, as amended, 42 U.S.C. §9601, et
<br />s~ the Hazardous Materials Transportation Act, 49 U.S.C. §1801, et s! ~ the Resource
<br />Conservation and Recovery Act, and any law, ordinance or regulation dealing with
<br />underground storage tanks; and in the regulations adopted, published and/or promulgated
<br />pursuant to said laws, and in any other environmental law, regulation or ordinance now
<br />existing or hereinafter enacted (collectively, "Hazardous Materials Laws").
<br />(b) Landlord's Representations and Warranties Re: Condition of
<br />Premises at Commencement of Lease. Landlord hereby represents and warrants to
<br />Tenant as follows, which representations are made as of the date of execution of the
<br />Lease and as of the Lease Commencement Date:
<br />i) No Violation of Hazardous Material Laws. Landlord has not
<br />generated, manufactured, refined, transported, treated, stored, handled,
<br />disposed of, transferred, produced or processed any Hazardous Materials
<br />on the Premises, except in full compliance with all Hazardous Materials
