9 FACE 558 <br />AN ORDINANCE TO AMEND THE ZONING ORDINANCE <br />OF LEE COUNTY, NORTH CAROLINA <br />BE IT ORDAINED, by the Board of Commissioners of Lce County, North Carolina that the <br />Zoning Ordinance of Lee County, North Carolina be, and it hereby is, amended as follows: <br />Section 1. Amend the Lcc CounaY Zoning Ordinance, Article \711, District Regulations, Section 3. <br />Table of Permitted Uses by deleting the "S" under the column headed by RA beside the use <br />"Sanitary Landfill", and by replacing the under the column headed by FII with an "S" beside the <br />use "Sanitary Landfill"; thereby prohibiting sanitary landfills in the Residential Agricultural (RA) <br />District and allowing such use in the I-leavy Industrial District as a Special Use subject to the <br />issuance of a Special Use Permit. <br />Section 2. Amend Article \71 1, District Regulations, Section 4.3 Regulations for S )ecial Use Permits <br />by adding new development regulations for sanitary landfills as follows: <br />"Use: Sanitary Landfill <br />Special Use District <br />FI 1 <br />Applic_ ability <br />Any Sanitary Landfill, which means a facility for disposal of solid waste on land in a sanitary, manner <br />in accordance with the rules concerning sanitary landfills adopted under this Article. (Source. NCGS <br />g 130A-290). <br />Standards for Sanitary I-andfills <br />1) Approval of the Special Use permit will not become effective unless all applicable permits for <br />solid waste facilities have been issued by the appropriate State and Federal agencies governing <br />operation of the facility. Special Use pert-nits will automatically expire if at any dine after the <br />1SS11a11CC State or Federal permits are revoked. <br />2) Buffers and screening shall be established along road frontages and around all sides of a solid <br />waste facility. The buffers and screening shall be a nvnimum of fifty (50) feet wide and shall <br />conform to the requirements of Article \1V. Trees shall be of such height when planted that they <br />shall reach a height of ten (10) feet in two (2) years. <br />3) Onhv one (1) ground sign per entrance to the storage yard is permitted. Such sign shall not <br />exceed thine (9) square feet in area. If lighted, such sign may include indirect lighting or non-flashing <br />illumination. Such sign shall be located on the same lot or parcel as the solid waste facility. <br />
