BOOK &9 NNE shs <br />credit of the county within the meaning of the Constitution of the State. This agreement <br />shall not directly or indirectly or contingently obligate the county to make any payment <br />beyond those appropriated in the sole discretion of the county for any fiscal year in which <br />the agreement is in affect; provided, however, that any failure or refusal by the county to <br />appropriate funds which results in the failure by the county to make any payment coming <br />due hereunder will in no way obligate the occurrence of the event of default resulting <br />from such non-payment. No deficiency judgment may be rendered against the county in <br />any action for breach of a contractual obligation under this agreement and the taxing <br />power of the county is not and may not be pledged directly or indirectly or contingently <br />to secure any monies due unto this agreement. <br />(c.) No provision of this agreement shall be construed to pledge or to create <br />a lien on any class or source of the county's monies, any provision of this agreement <br />restrict the future issuance of any of the county's bonds or monies. To the extent of any <br />conflict between this section and any other provision of this agreement, this section shall <br />take priority. <br />14. All notices herein provided to be given, or which may be given by either <br />party to the other, shall be deemed to have been fully given when made in writing and <br />deposited in the United States mail, certified and postage prepaid and addressed as <br />follows: To the Lessor, P. O. Box 568, Sanford, North Carolina, 27331-0568, and the <br />Lessee at P. O. Box 1968, Sanford, North Carolina, 2733 1-1 968. Nothing herein <br />contained shall preclude the giving of such notice by personal service.
