110 i9 P"GE 479 <br />CITY OF SANFORD WATER SHORTAGE ORDINANCE JULY 30, 2003 <br />d. When a final decision is issued under Section of this <br />section, the City Attorney shall prepare an official record of the case <br />that includes: <br />1. All notices, motions, and other like pleadings; <br />2. A copy of all documentary evidence introduced; <br />3. A certified transcript of all testimony taken, if testimony is <br />transcribed. If testimony is taken and not transcribed, then a <br />narrative summary of any testimony is taken. <br />4. A copy of the final decision of the City Council. <br />e. Any applicant against whom a final decision of the Sanford City <br />Council is entered, may appeal the order or decision by filing a written <br />petition for judicial review in the nature of certiorari within 30 days <br />after receipt of notice by certified mail of the order or decision to the <br />General Court of Justice of Lee County. A copy of the appeal shall be <br />served on the City Attorney. <br />The City Manager has the right to vary these procedures or time <br />requirements as lie pleases. <br />DIVISION V.GENERALI.Y <br />Sec. Severablility <br />If any provision of this Ordinance is declared unconstitutional, or the <br />application thereof to any person or circumstance is held invalid, the <br />constitutionality of the remainder of the Ordinance and it applicability to <br />other persons and circumstances shall not be affected thereby. <br />Sec. Effective Date <br />This Ordinance shall take effect immediately upon adoption by the City <br />Council of the City of Sanford, North Carolina. <br />7115/03 Page I I of 12 <br />
