0 0 <br />50 i9 FACE 0-17 <br />RESOLUTION AUTHORIZING AUCTION SALE <br />OF <br />REAL PROPERTY <br />KNOWN AS THE PARKING DECK <br />WHEREAS, The County of Lee owns a parcel of land which is known as the <br />"parking deck" and which is more fully described in a deed recorded in Book 100 Page <br />368 in the Lee County Registry that is surplus to its needs; and <br />WHEREAS, North Carolina General Statute § 160A-270, which is made <br />applicable to counties by North Carolina General Statute § 153A-176, permits the County <br />to sell real property at public auction upon approval of the Board of Commissioners and <br />after publication of a notice announcing the auction; <br />THEREFORE, The Board of Commissioners of The County of Lee resolves <br />that: <br />1. The parcel of land known as the "parking deck" and described in Book 100 <br />Page 368 in the Lee County Registry is declared to be surplus to the needs of <br />the County. <br />2. The Board of Commissioners authorizes the sale at public auction of the <br />parcel of land as hereinbefore described. <br />3. Clinton C. Pickard, Auctioneer, is authorized to receive bids in the Board of <br />Commissioner's behalf at public auction for the purchase of the parcel as <br />hereinbefore described. <br />4. The terms of the sale are that the high bidder must present at the auction a bid <br />deposit of five percent (5%) of the amount of the bid, either in cash, certified <br />check or bank money order. This deposit will be held by the County until <br />either the Board of Commissioners rejects the high bid for the property or, if <br />the Board of Commissioners accepts the high bid, the closing of the sale, the <br />deposit will be forfeited to the County if the high bidder refuses to close the <br />sale after the bid has been approved and accepted by the Board of <br />Commissioners. <br />5. The Clerk to the Board shall cause a Notice of Public Auction to be published <br />in accordance with North Carolina General Statute § 160A-270(a), once the <br />date of the auction is determined. <br />
