0 ao;N' i9 FacF 147 <br />SUGGESTED RESOLUTION <br />WHEREAS, the operation of a motorized all terrain vehicle on private property <br />not owned by the operator, without the consent of the owner, is a violation of N.C. <br />General Statute §14-159.3 and is a Class 2 iMisdemeanor; and <br />WHEREAS, the enforcement of this statute has been difficult because law <br />enforcement officers have been unable to apprehend operators due to the ability of the <br />motorized all terrain vehicles to operate in areas not accessible to law enforcement <br />vehicles and as a consequence property owners are not receiving the protection <br />contemplated by the enactment of N. C. General Statute §14-159.3; and <br />WHEREAS, this problem exists statewide and has been addressed by the <br />Robeson County Board of Commissioners by a resolution adopted on .Tune 7, 1999. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of <br />Lee County as follows: <br />That it supports the positions taken in the resolution adopted by the Robeson <br />County Board of Commissioners on June 7, 1999, and joins in its petition to <br />the General Assembly to enact statewide legislation to require registration of <br />motorized all terrain vehicles. <br />2. That the legislative delegation representing Lee County in the General <br />Assembly is requested to support and to seek enactment of statewide <br />legislation of a registration system for motorized all terrain vehicles, which <br />will facilitate enforcement of N.C.
