BE IT RESOLVED g`p.OK 17 l"r l <br />1 <br />That the Board of Commissioners of the Lee County Water and <br />Sewer District No. 1, hereby, amends resolutions adopted <br />November 20, 1995 and August 19, 1996, passed in connection <br />with USDA Rural Development loan and grant request. <br />Let it be known that the Board continues to accept the <br />conditions set for in a Letter of conditions dated November <br />20, 1995, as revised December 18, 1995; and accepts the <br />revisions to said letter of conditions dated , and <br />by this resolution, adopts a revised Form FmHA 1942-47, Loan <br />Resolution dated , and a Form FmHA 1942-31, <br />Association Water or Sewer System Grant Agreement. <br />The purpose and intent of the revisions to the Letter of <br />Conditions, Loan Resolution, and Grant Agreement being the <br />request and offer of a subsequent loan to meet revised total <br />project cost and associated revisions to rate structure due <br />to increased debt service. <br />That the Board of Commissioners of the Lee County Water and <br />Sewer District No. 1, approves as shown the revised Form <br />FmHA 442-7, Operating Budget (the Proposed Budget) dated <br />That the Chairman and Secretary be authorized to execute all <br />forms necessary to obtain a loan and grant from USDA Rural <br />Development, including, but not limited to the following <br />forms: <br />Form <br />FmHA 1942-47 <br />Loan Resolution <br />Form <br />FmHA 1942-31 <br />Association Water or Sewer System <br />Grant Agreement <br />Form <br />FmHA 442-46 <br />Letter of Intent to Meet Conditions <br />Form <br />FmHA 442-7 <br />Operating Budget <br />Form <br />FmHA 400-1 <br />Equal Opportunity Agreement <br />Form <br />FmHA 400-4 <br />Assurance Agreement <br />Form <br />FmHA 1940-1 <br />Request for Obligations of Funds <br />Form <br />FmHA 1910-11 <br />Applicant Certification Federal <br />Collection Policies <br />Form <br />AD-1047 <br />Certification Regarding Debarment <br />Form <br />AD-1049 <br />Certification Regarding Drug Free <br />Workplace <br />That <br />if the inter <br />est rate charged by USDA Rural Development <br />shoul <br />d change bet <br />ween this date and the date of actual <br />approval, the Cha <br />irman and Secretary be authorized to <br />execute new forms <br />reflecting the current interest rate and <br />revised payments <br />as required by USDA rural Development. <br />That the Board of Commissioners elects to have the interest <br />charged by USDA Rural Development to be the lower of the <br />rate in effect at either the time of loan approval or loan <br />closing. <br />?_4 <br />The proposed rate schedule for residential water use is as <br />follows: <br />
