0 K OK w FACE 156 <br />engages in misconduct or other conduct which, in Sandhills Center's sole judgment, is <br />detrimental to the reputation or operation of Sandhills Center, or if the staff member is no longer <br />qualified to perform his/her employment duties as a result of a change of status in his/her <br />credentials or licensure. Nothing contained herein shall constitute an employment contract with <br />any Lee-Harnett Authority staff member. Lee-Harnett employees hired by Sandhills Center will <br />be hired at their December 1, 2004 salary unless that salary exceeds the current Sandhills Center <br />Pay Plan for the same job classification. Those employees whose salaries exceed the Sandhills <br />Center Pay Plan will have their salaries reduced effective July 1, 2005 to bring them into line <br />with the highest salary in the Sandhills Pay Plan for their job classification. Following July 1, <br />2005 all Sandhills Center staff positions will undergo a classification and salary review. Any <br />employees who are hired by Sandhills will be subject to Sandhills' pay plan. Attached hereto as <br />Exhibit D is a list of budgeted Lee-Harnett positions by hiring category. With respect to <br />employees hired by Sandhills Center, longevity and tenure with Lee-Harnett Authority shall be <br />counted as credit for employment with Sandhills Center, and said employees shall have and <br />enjoy all rights and benefits set forth in Sandhills Center's Personnel Policy for such longevity <br />and tenure. Former Lee-I-Iarnett employees hired by Sandhills will have the option of transferring <br />all accrued sick and annual leave to Sandhills Center. Effective January 1, 2006, all annual leave <br />in excess of thirty (30) days will be rolled over into the sick leave account. All employees hired <br />by Sandhills Center who were formerly employed by Lee-Harnett Authority will be entitled to <br />any health or retirement benefits ordinarily offered to employees of Sandhills Center, and <br />Sandhills Center shall have no duty or obligation to continue any health-care plan, retirement <br />plan, or any other benefit to which the employee was entitled as an employee of Lee-Harnett <br />Authority. Sandhills Center will have no administrative or fiduciary duty for any health or <br />retirement plans in which any Lee-Harnett Authority employee participated prior to July 1, 2005. <br />However, Sandhills Center will permit any such employee to transfer or roll over any retirement <br />funds into Sandhills Center's retirement plan. <br />9. No transfer of liability. Nothing contained in this Agreement shall constitute a <br />transfer or assignment of any liability from any party to another party. <br />10. Lee-Harnett Authoritv's Mental Health, Developmental Disabilities, <br />Substance Abuse Program's Unreserved Fund Balance. On the effective date of this <br />Agreement, July 1, 2005, the Lee-Harnett Authority shall transfer to Sandhills Center its entire <br />12/07/2004 10.40 AM 5 <br />
