E;OX 20 PAGE 10- <br />any financial claims against the County or District, and the County and <br />District agree to drop any claims against the City, relative to the water <br />systems. <br />5. City agrees to perform a water rate study no later than Fiscal Year 07-08. <br />Rates adopted upon completion of the rate study will be as equitable as the <br />Local Government Commission will allow. In the interim, City agrees to <br />respect the integrity of the current rate structure for District, County and <br />City customers. Accordingly, any required rate adjustments prior to the <br />water rate study will be equitable. <br />6. In order to effect the orderly growth of the consolidated water system, <br />County and District agree to adopt rules for its citizens consistent with those <br />affecting other customers on the consolidated system. County and District <br />agree to use their governmental powers to enforce future and current <br />regulations of the water system, including, if necessary, to the extent <br />allowed by law, to levy and collect assessments in order to allow for <br />expansion of the system. City agrees to collect past due accounts and seek <br />disconnection of service for unpaid customers. In the event the City cannot <br />accomplish this, County and District agree to use their governmental powers <br />to effect the disconnection and collection of past due accounts and shall <br />remit the proceeds to the City, with the cost and expenses associated with <br />this activity paid by the customers. <br />7. No extensions or connections shall be made to the City's water system <br />without the express permission of the City.
