I- <br />L <br />e~t~n F c A-A <br />STATE OF NORTH CAROLINA <br />COUNTY OF LEE <br />INTERLOCAL AGREEMENT FOR THE CONSOLIDATION OF CERTAIN <br />PUBLIC WATER SYSTEMS WITHIN LEE COUNTY <br />THIS AGREEMENT made and entered into this day of 2004, <br />by and between the City of Sanford, a North Carolina municipal Corporation (hereinafter <br />referred to as "City"), the County of Lee, one of the one hundred counties of the State of <br />North Carolina and a body both Corporate and Politic, (hereinafter referred to as <br />"County"), and the Lee County Water and Sewer District No. 1, a North Carolina <br />municipal corporation, (hereinafter referred to as "District"). <br />WITNESSETH: <br />WHEREAS, the City of Sanford, County of Lee and the Lee County Water and <br />Sewer District No. I currently own public water systems within Lee County; and <br />WHEREAS, the City currently operates these water systems for the County and <br />District in accordance with existing contract documents; and <br />WHEREAS, the lines owned by the County and District are extensions off of the <br />City's water system, and <br />WHEREAS. disputes and differences have arisen between the parties about the <br />operation and maintenance of the lines owned by the City and District; and <br />WHEREAS, the configuration of the County and District lines does not <br />reasonably adapt itself to establishment of a separate and independent system for the <br />County and District, and the parties have agreed that the settlement of the differences <br />between the parties can best be accomplished by the transfer of the County and District <br />water system assets to the City. <br />NOW, THEREFORE, the parties hereto agree as follows: <br />1. For and in exchange for the payment of the debt owed by the Lee County <br />Water District No. I to the Farmer's Home Administration and First <br />Citizens Bank, County and District agree to transfer all the assets of the <br />County and District water systems to the City. <br />Any contract of sale or other document for the transfer of ownership must <br />include the following- statement: <br />
