MEMORANDUM OF UNDERSTANDING Between <br />THE COUNTY OF LEE AND THE SANFORD FARMER'S MARKET <br />This Memorandum of Understanding is between the County of Lee (hereinafter referred to as the <br />"County") and the Sanford Farmer's Market (hereinafter referred to as "Farmer's Market"). This <br />Memorandum of Understanding memorializes the parties desire to allow the Farmer's Market to <br />hold the weekly market with vendors at the McSwain Center, the building where N.C. <br />Cooperative Extension -Lee County Center is located. Both parties understand and agree to the <br />following: <br />1. N.C. Cooperative Extension -Lee County Center is located at the McSwain Center, 2420 <br />Tramway Road, Lee County. The McSwain Center is owned and operated by the <br />County. <br />2. The County agrees to allow the Farmer's Market the right to utilize its parking lot and the <br />immediate area surrounding the parking lot in order to conduct its business of selling <br />crops to local citizens. <br />3. The Farmer's Market can utilize this space on Saturday morning's beginning each year in <br />April until October. The Farmer's Market can allow its vendors the right to sell their <br />crops to the public from 9:00 am until 12:00 pm. <br />4. The Farmer's Market Manager or Assistant Manager must be present while any Farmer's <br />Market business transactions are occurring. <br />5. The Market Manager or Assistant Manager will be responsible for the key to the building <br />which will allow access to the hallways and bathrooms in the McSwain Center. <br />6. The County will provide restrooms for the vendors but not the general public, except in <br />cases of emergencies. <br />7. The Farmer's Market and its vendors will be responsible for removing any and all of its <br />trash and leaving the area neat and clean after each Saturday's sale. <br />8. If the County needs to use the parking lot any Saturday when the Farmer's Market is <br />operating, the County will give the Market Manager at least one week's notice for the <br />market to get in touch with its vendors and to notice the public. <br />9. The Market Manager will be required to provide at least one week's notice to County <br />Extension Director if the Farmer's Market will not be held on any Saturday during the <br />duration of the agreed upon dates. <br />10. The County will not be responsible or liable for any damage done to any of the vendor's <br />equipment, vehicles, or crops. <br />11. The Farmer's Market will ensure the vendor's do not leave any crops or equipment <br />overnight at the McSwain Center and ensure that everything is set up between the hours <br />of 8:00am and taken down before 1:00pm each Saturday the Farmer's Market is in <br />operation. <br />12. The Farmer's Market must provide proof of liability insurance before the County enters <br />into the contract and that proof must be provided every year to the County. <br />
