0 auox 23 F~ic= 50) <br />The property containing the area described in Exhibit "A" was acquired by the <br />Grantor by instrument recorded in the Lee County Registry of Deeds in Deed Book 917, <br />Page 862. <br />Said widths, station numbers, survey lines and additional areas being delineated <br />on that set of plans drawn by Hydrostructures, PA, are on file in the office of the City of <br />Sanford Engineering Department to which plans reference is hereby made for greater <br />certainty of description of the areas herein conveyed and for no other purpose. <br />SPECIAL PROVISIONS <br />This easement is subject to the following provisions only: <br />1. In the event that the easement use granted herein is permanently discontinued <br />by Grantee, its successors or assigns, then the easement will terminate and the <br />property described above will revert back to the Grantor and upon request, the <br />Grantee will execute a Termination of Easement Agreement in recordable <br />form. <br />2. Grantor shall have the right to relocate the easement and any utility located <br />thereon or thereunder to a different location on Grantor's property reasonably <br />acceptable to Grantee at the sole cost and expense of Grantor, provided that <br />any amendment will be properly described and/or surveyed, and said revision <br />will be recorded at the Lee County Register of Deeds Office at the expense of <br />Grantor. <br />I It is understood and agreed that the temporary construction easement referred <br />to on the attached Exhibit "A" is of a temporary nature and will expire at the <br />completion of the project. There are no conditions to this easement not <br />expressed herein. <br />4. The Grantor by the execution of this instrument acknowledges that the plans <br />for the aforesaid project as they affect its property have been fully explained <br />to it. <br />SAID EASEMENT is to be used and enjoyed by the Grantee, its successors and <br />assigns, to keep up, repair, and maintain said sewer line, lift station, road and sewer <br />system, and use the same as far as may be necessary for said purpose, with the right of <br />ingress and egress thereto thereon at all times. The Grantee, its successors and assigns, <br />shall have the right to cut and remove such trees and growth in, upon and along said <br />sewer line as may interfere with the installation, laying, upkeep and maintenance of said <br />sewer line for the width and purpose herein stated. <br />TO HAVE AND TO HOLD the aforesaid easement and all privileges and <br />appurtenances thereunto belonging to the Grantee in perpetuity. <br />
