f- C <br />UUA <br />"Grantee agrees to indemnify and hold grantor harmless from and against <br />any and all claims of any nature whatsoever arising out of or related <br />to the activities, acts or omissions, whether or not negligent, or Grantee,. <br />its employees, agents or contractors on or near the permanent easement <br />or the construction easement granted herein." <br />This provision is and remains applicable only to the Assignor. <br />Assignor represents and warrants that it has made no other assignment of any of <br />its rights under the Deed of Easement referred to above to any other person or entity; that <br />it has done no act, nor failed to do any act, which might prevent Assignee from exercising <br />any of the rights, powers, and privileges conferred upon Assignor by the said Deed of <br />Easement. <br />IN WITNESS WHEREOF, the Assignor has caused this instrument to be <br />executed in its name by its duly authorized officers and its seal to be hereunto affixed, the <br />day and year first above written. <br />COUNTY OF LEE <br />By. <br />Herbert A.
