i~7R i9 F GE <br />RESOLUTION <br />AUTHORIZING AUCTION SALE <br />OF REAL PROPERTY <br />WHEREAS, the County of Lee owns two parcels of land indicated on "Attachment A" <br />that are surplus to its needs; and <br />WHEREAS, North Carolina General Statute Section 160A-270, which is made <br />applicable to counties by North Carolina General Statute Section 153A-176, permits the county to <br />sell real property at auction upon approval of the Board of Commissioners and after publication <br />of a notice announcing the auction: <br />THEREFORE, the Board of Commissioners of the County of Lee resolves that: <br />1. The two parcels of land described on "Attachment A" are hereby declared surplus to <br />the needs of the County. <br />2. The Board of Commissioners authorizes the sale by public auction of the two parcels <br />of land described on "Attachment A." <br />3. Clinton C. Pickard, Auctioneer, is authorized to receive bids in the Board of <br />Commissioners behalf at public auction for the purchase of the parcels described in <br />"Attachment A." <br />4. The public auction will be held on Tuesday, JuhV 13, 2004; at 6:00 o'clock p.m. at the <br />old Department of Motor Vehicle building situated at 1500 Old Carbonton Road, <br />Sanford, NC. <br />5. The terms of the sale are that the high bidder nwst present at the auction a bid deposit <br />of five percent (5%) of the amount of the bid, either in cash, certified check or bank <br />money order. The County will hold this deposit until either the Board of <br />Commissioners rejects the high bid for the property or, if the Board of <br />Commissioners accepts the high bid, the closing of the sale. The deposit will be <br />forfeited to the County if the high bidder refuses to close the sale after the bid has <br />been approved and accepted by the Board of Commissioners. <br />6. "File Clerk to the Board shall cause a notice of the public auction to be published in <br />accordance with North Carolina General Statute 160A-270(a). <br />7. After the auction, the high bid for each parcel shall be reported to the Board of <br />Commissioners. The Board will accept or reject the bid within thirty days (30) after <br />the bid is reported to it. No sale will be completed until the Board has approved the <br />high bid. <br />8. "File County reserves the right to withdraw any listed property from the auction at any <br />time before the auction sale of that property. <br />
