0 GGD`n 29 FIGE. <br />Audits, LLC evaluated the information Charter submitted, requested and received <br />supplemental information and evaluated the information with respect to conformance to <br />FCC rules. Mr. Hoyle stated that Charter subscribers would be charged a "selected" <br />monthly rate of $10.92 (from 59.95) for the Basic Service tier for the period July 2003 - <br />June 2004. The maximum permitted rate and the "selected" monthly rate are identical. <br />Subscribers receiving only BST service will experience an overall combined monthly rate <br />increase of 97-cents over last year. <br />No one present spoke for or in opposition to the proposed rate increase for Charter <br />Communications. <br />Chairman Hincks closed the public hearing. <br />Commissioner Paschal moved to approve "An Order Finding Charter <br />Communication's 2003-2004 FCC 1240 Basic Service Tier and FC 1205 Installation <br />Rates Comply with the FCC's Rules and are Subject to the Conditions Stated Herein a <br />copy of which is attached to these minutes and by this reference made a part hereof. <br />Upon a vote, the results were as follows: <br />Aye: Adams, Hincks, Lemmond, Matthews, Paschal, and Stevens <br />Nay: Reives <br />The Chairman ruled the motion had been adopted by a six to one vote. <br />Chairman Hincks opened the first joint public hearing with the Planning Board for <br />a petition by Paul Utley to rezone from Residential Restricted district to Highway <br />Commercial district, 1.15 acres of land located at 3604 Hawkins Avenue. Planner Althea <br />Thompson outlined the rezoning petition and answered questions from both Boards. <br />Paul Utley of 350 Labrador Lane spoke in favor of the rezoning petition. <br />No one present spoke in opposition to the petition. <br />Chairman Hincks closed the first public hearing and opened the second and final <br />advertised public hearing for a petition by Donna Poe to rezone from Residential <br />Agricultural district to Highway Commercial district, 2 acres of land located at 3131 <br />Jefferson Davis Highway. Planner Althea Thompson outlined the rezoning petition and <br />answered questions from both Boards. <br />Jade Wicker of 1231 Radcliff Drive, representing Donna Poe, spoke in favor of <br />the rezoning petition. <br />No one present spoke in opposition to the petition. <br />Chairman Hincks closed the public hearing and recessed the meeting while <br />members of the Planning Board deliberated on the above rezoning petitions. <br />6 <br />
