BON 19 FAc0 89 <br />accepted by the Lee County Community Development Office, there shall be an equitable adjustment <br />of compensation based on the Lee County Community Development Office's determination. <br />10. No person employed on the work covered by this Contract shall be discharged or in any way <br />discriminated against because he has filed any complaint or instituted or caused to be instituted any <br />proceeding or has testified or about to testify in any proceeding under or any relating to the labor <br />standards, applicable hereunder to his employer. <br />II. The Contractor's Obligations and duties under this Contract shall not be assigned, in whole or in part, <br />without prior approval of the Lee County Community Development Office. <br />12. Conflict of Interest: The Contractor covenants that he presently has no interest and shall not acquire <br />any interest, direct or indirect, in the above described Project Area or any parcels therein or any <br />other interest which would conflict in any manner or degree with the performance of his services <br />hereunder. The Contractor further covenants that in the performance of this Contract, no person <br />having such interest shall be employed. The above covenant of no interest also applies to the <br />contractor's immediate family and his or her business partners. <br />13. For the consideration named herein, the Contractor agrees to furnish all labor, materials, equipment, <br />services, and permits and do all work described in and in accordance with the work write-up and <br />identified above in this Contract. <br />14. Certificate of Completion and procedure for final payment of the Contract: <br />Upon completion of the work required to be performed by the Contractor in accordance with the <br />Contract and the Property Rehabilitation Standards, and upon certification by the Building Inspector, <br />The Lee County Community Development Office shall so indicate by issuing a Certificate of Final <br />Inspection. <br />If the Lee County Community Development Office signs the Certificate of Final Inspection, then the <br />County shall be authorized to deliver a check to the Contractor for final payment under the terms of <br />the Contract, and the check shall be issued directly to the Contractor. <br />If the owner refuses to sign the acceptance, a process for reviewing the owner's complaints about <br />the Contractor's work shall begin. The process shall begin on the date that the owner refuses to sign <br />the acceptance. <br />The Lee County Community Development Office shall review the owner's statement, if the Lee <br />County Community Development Office concludes that the owner is correct in any or all of the <br />information indicated, then the Lee County Community Development Office may revoke its signing of <br />the Certificate, unless the Contractor makes those changes or corrections that the Lee County <br />Community Development Office concludes are justifiable. <br />At the end of the thirty (30) day period, if the Lee County Community Development Office concludes <br />either that the statement submitted by the owner is without basis or that the statement has been <br />satisfied by the Contractor to the extent required by the Lee County Community Development Office, <br />then the Lee County shall have authority to issue the check directly to the Contractor for the balance <br />of the contracted amount. <br />The Lee County Community Development Office shall have final determination as to whether the <br />terms of the Contract have been satisfied in all disputes. <br />15. Lead Based Paint Clause: The Contractor is hereby specifically made aware of DCA lead-based paint <br />regulations, 4 NCAC 19L Rule .1011, which are applicable to the construction or rehabilitation of <br />WORK CONTRACT <br />
