0 BOOK A202 mF 651 <br />AN ORDINANCE AMENDING <br />THE LEE COUNTY UNIFIED DEVELOPMENT ORDINANCE <br />BE IT ORDAINED by the Board of Commissioners for Lee County, North Carolina that the <br />Unified Development Ordinance be, and it hereby is, amended as follows: <br />Section 1. Article 5. Supplemental Development Regulations, Section 5.34 Temporary Uses, <br />subsection 5.34.2.2, be rewritten as follows: <br />5.3422 TEMPORARY RETAIL SALES (excluding agri-tourism sales). Any person <br />or persons, corporation, or agent vaho engages in the business of periodic outdoor sales (and/or <br />exhibiting for sale) of retail goods and/or merchandise who in fit rtherance of such purpose <br />leases, uses or occupies may lot, tract or space shall conform to the following requirements: <br />• Temporary retail sales may only be pertained only within non-residential zoning <br />districts (NC O&l, CBD, C-1, C-2, L1, and Ill). <br />• No more than six (6) periodic retail sales events shall be permitted per tax parcel <br />within a given calendar year. <br />• A periodic retail sales event shall be permitted to operate up to a maximum of ten (10) <br />consecaaive days, except that concessionaire vendors (see Appendix A for definition) <br />are exempt from this tune limit. A mininnan thirty (30) day separation shall be <br />required between periodic retail sales events that are to be conducted on the some <br />parcel. <br />• A single temporary sign (size permitted as sea fin th in Section 11. of this <br />Ordinance) shall be allowed.for the dm ation of the temporary sales event. <br />Section 2. Appendix A, Definitions, be rewritten to include the following new definition: <br />Concessionaire Vendor - A vendor of food, drink or other similar consumable products which <br />may operate fron a cart or other similar mobile or temporary structure and has been given <br />permission to locate at the exterior of an existing business site for the purposes of vending <br />such products to the customers of that existing business. Concessionaire vendors' <br />trailers/carts shall: <br />• be restricted to a maximum dimension of 8.5 feet x 20 feet; <br />• be located within 50 feet of one of the main entrances to the business which is <br />sponsoring the vendor, and <br />• be located so as to not block or otherwise impede the mininnon standards for <br />ingress/egress of a building as set forth in the State Building and Fire Codes. <br />A vendor shall have a completed "Proof of Concessions Agreement" to demonstrate its <br />standing as a valid concessionaire, which will require annual renewal and approval by the <br />Administrator. <br />Section 3. This ordinance shall be in full force and effect from and after the date of its <br />adoption. <br />
