ME <br />g. Iran -Divestment Certification: Company certifies that Company is not listed <br />on the Iran Final Divestment List created by the North Carolina State Treasure <br />pursuant to N.C.G.S. 147-86.58 (the "Final Divestment List"). Further, <br />Company's subcontractor, if utilized, will also not be listed on the Final <br />Divestment List. The Final Divestment List can be found on the State <br />Treasurer's website at the address www.nctreasurer.com/Iran and should be <br />updated every 180 days. <br />h. E -Verify Certification: Company agrees that it shall comply with the <br />requirements of Article 2 of Chapter 64 of the General Statutes. Further, if <br />Company utilizes a subcontractor, Company agrees that it shall require the <br />subcontractor to comply with the requirements of Article 2 of Chapter 64 of the <br />General Statutes. <br />4. Grant. <br />a. In exchange for the Taxable Investment by the Company, the creation of New <br />Jobs paying the average annual wage rate as stated herein, and pursuant to <br />North Carolina General Statutes 158-7.1, the County anticipates making an <br />incentive grant to the Company of up to FIVE HUNDRED AND TWELVE <br />THOUSAND, TWO HUNDRED AND THIRTY-EIGHT DOLLARS <br />($512,238.00) over a five (5) year period, paid in annual installments as <br />shown on the attached Exhibit A. <br />5. Performance Criteria. <br />a. The Company agrees to undertake and operate in a timely manner the <br />following new project in connection with its manufacturing operations in Lee <br />County: expansion of the Company's manufacturing operations located at its <br />Sanford, North Carolina facility, by purchasing new manufacturing machinery <br />and equipment in the facility and the hiring of sixty-six new employees. <br />b. Existing Jobs. The Company agrees to retain its current level of operations at <br />its facility in Lee County and to maintain a base level of the 224 full-time <br />existing jobs (hereinafter "Existing Jobs") at the facility through the end of the <br />Incentive Period as set forth in paragraph 1 of this Agreement, in addition to <br />the New Jobs to be created as part of this Agreement, as further described <br />herein. <br />c. New Jobs. The Company agrees to create and maintain sixty-six, permanent, <br />full-time New Jobs, broken down as follows: at least have employed twenty- <br />seven (27) New Jobs by the end of Year One, showing proof to the County, <br />and employed an additional thirty-nine (39) new jobs by the end of Year <br />Three, showing proof to the County. These new jobs must be proved before <br />any incentive payment will be made to the Company each year of the <br />agreement, and proof that Company has maintained the Existing Jobs. All <br />sixty-six New Jobs shall be maintained through the end of the Incentive <br />Period as set forth in Paragraph 1 of this Agreement.
