ME g. Iran -Divestment Certification: Company certifies that Company is not listed on the Iran Final Divestment List created by the North Carolina State Treasure pursuant to N.C.G.S. 147-86.58 (the "Final Divestment List"). Further, Company's subcontractor, if utilized, will also not be listed on the Final Divestment List. The Final Divestment List can be found on the State Treasurer's website at the address www.nctreasurer.com/Iran and should be updated every 180 days. h. E -Verify Certification: Company agrees that it shall comply with the requirements of Article 2 of Chapter 64 of the General Statutes. Further, if Company utilizes a subcontractor, Company agrees that it shall require the subcontractor to comply with the requirements of Article 2 of Chapter 64 of the General Statutes. 4. Grant. a. In exchange for the Taxable Investment by the Company, the creation of New Jobs paying the average annual wage rate as stated herein, and pursuant to North Carolina General Statutes 158-7.1, the County anticipates making an incentive grant to the Company of up to FIVE HUNDRED AND TWELVE THOUSAND, TWO HUNDRED AND THIRTY-EIGHT DOLLARS ($512,238.00) over a five (5) year period, paid in annual installments as shown on the attached Exhibit A. 5. Performance Criteria. a. The Company agrees to undertake and operate in a timely manner the following new project in connection with its manufacturing operations in Lee County: expansion of the Company's manufacturing operations located at its Sanford, North Carolina facility, by purchasing new manufacturing machinery and equipment in the facility and the hiring of sixty-six new employees. b. Existing Jobs. The Company agrees to retain its current level of operations at its facility in Lee County and to maintain a base level of the 224 full-time existing jobs (hereinafter "Existing Jobs") at the facility through the end of the Incentive Period as set forth in paragraph 1 of this Agreement, in addition to the New Jobs to be created as part of this Agreement, as further described herein. c. New Jobs. The Company agrees to create and maintain sixty-six, permanent, full-time New Jobs, broken down as follows: at least have employed twenty- seven (27) New Jobs by the end of Year One, showing proof to the County, and employed an additional thirty-nine (39) new jobs by the end of Year Three, showing proof to the County. These new jobs must be proved before any incentive payment will be made to the Company each year of the agreement, and proof that Company has maintained the Existing Jobs. All sixty-six New Jobs shall be maintained through the end of the Incentive Period as set forth in Paragraph 1 of this Agreement.
