040 <br />LEE, COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION AMENDING CHAPTER 14, ARTICLE II OF THE LEE COUNTY CODE OF ORDINANCES <br />CONCERNING THE LEE COUNTY LIBRARY <br />WHEREAS, counties are granted broad police power authority to protect the health, safety, and <br />welfare of county employees and the general public by North Carolina General Statutes Section 153A- <br />121; and, <br />WHEREAS, the General Assembly has recognized the need for adequate and modern library <br />services and facilities for its North Carolina citizens and that a county may establish, operate, and <br />support public library systems pursuant to Section 153A-263 of the General Statutes of North Carolina; <br />and, <br />WHEREAS, because the Lee County Board of Commissioners desires to provide the citizens of <br />Lee County with adequate library services and facilities, it passed a Library ordinance granting the <br />county library system and establishing a board of trustees, on March 17, 1980, codified at Chapter 14 of <br />the Lee County Code of Ordinances; and, <br />WHEREAS, at the time of adoption, the Lee County Board of Commissioners granted the board <br />of trustees the right to appoint a chief librarian, pursuant to Chapter 14, Article II, Section 14-41, "the <br />library board of trustees of the county library system shall have the power to appoint and designate a <br />chief librarian who possesses the necessary educational training and who demonstrates by actual work <br />the ability to organize and direct a countywide library system. Such other trained persons as may be <br />necessary in the maintenance and operation of the library system may be employed;" and, <br />WHEREAS, Section 14-41 of the Lee County Library Ordinance gave the library board of trustees <br />the power to make personnel decisions of the chief librarian; and, <br />WHEREAS, the Lee County Board of Commissioners has recognized the difficulty the library <br />board of trustees, who are appointed volunteers, has in making personnel decisions regarding the chief <br />librarian and deems the board of trustees' role is better served with providing supervision over the <br />library facilities owned or controlled by the Lee County Board of Commissioners. <br />NOW, THEREFORE, BE IT ORDAINED, by the Lee County Board of Commissioners, Chapter 14, <br />Article II of the Lee County Code of Ordinances is amended as follows: <br />ARTICLE II. Board of Trustees <br />Section 14-36 Creation <br />There is hereby created a board to be known as the board of trustees of the county library system. The <br />county library system shall be a division of county government and the employees thereof shall be <br />employees of the county and shall be subject to the Lee County Personnel Policy. <br />
