RECOMMENDATION OF THE LEE COUNTY PLANNING BOARD 029 <br />FOR A CHANGE TO THE OFFICIAL ZONING MAP OF LEE COUNTY <br />APPLICATION 2016-1001 <br />The Lee County Planning Board, by a 5 to 2 vote, recommends the Lee County Board of <br />Commissioners approve Application #2016-1001 submitted by Wake Stone Corporation to <br />rezone 1.15 -acres of land formerly addressed as 6631 Deep River Road from Residential <br />Agricultural (RA) district to Heavy Industrial (HI) district. The members who cast the two <br />dissenting votes expressed concern over allowing the expansion of an existing use that has raised <br />concern among the residential neighbors. <br />LAND USE INFORMATION PRESENTED AT THE PUBLIC HEARING <br />History <br />Wake Stone Corporation has operated a rock quarry at this location since 1974. The operation <br />closed temporarily in 1983 and reopened in 1988. The quarry operation was a legally established <br />Special Use upon the adoption of countywide zoning in June 1990. In January 1993, the <br />property was zoned Heavy Industrial Conditional Use District to allow quarry operations on all <br />properties owned by Wake Stone at that time. In 2003, approximately 4 -acres was zone Heavy <br />Industrial Conditional Use (HI -CU) for construction of a vegetated earthen berm, and in 2010 <br />approximately 35.78 -acres was zone Heavy Industrial Conditional Zoning District for use in the <br />quarry operations. <br />Site and Area Description <br />The property to be rezone consists of a total of 1.15 -acres of land that includes a vacant .98 -acre <br />lot that was formerly addressed as 6631 Deep River Road, and a 0.17 -acre strip of land. The <br />properties was combined as illustrated on a survey for Wake Stone Corporation recorded in Plat <br />Cabinet 10, Slide 17F Lee County Registry of Deeds. The property lies north of Deep River <br />Road and is west of and adjacent to Wake Stone's current rock quarry operation. The subject <br />property also adjoins a 4 -acre tract that was rezoned for an earthen berm. The subject tract does <br />not have public street frontage and will be access through the existing quarry site that has over <br />2,000 feet of public street frontage on Deep River Road. <br />Surrounding Land Uses <br />Wake Stone's existing rock quarry adjoins the property requested to be rezoned. To the south <br />and being south of Deep River Road are residential lots with single-family homes. West of the <br />site adjoins low-density single-family homes and a 386± acre tract is vacant. <br />Staff Analysis and Information <br />The subject property is zoned Residential Agricultural (RA) district. The Residential <br />Agricultural (RA) district is established to provide areas for low-density single-family uses, low <br />intensity agricultural operations as well as agri-business and supportive industrial and <br />commercial uses. The dimensional requirements of the RA district include a minimum lot size <br />of 40,000 square feet (.92 acs.) and principal building setbacks of 30 feet front yard, 30 feet rear <br />yard and 15 feet side yards. <br />The Heavy Industrial (HI) district is established to provide for areas of heavy manufacturing, <br />concentrated fabrication, manufacturing and industrial uses which are suitable based upon <br />
