BK:00026 PG -0945 LEE COUNTY Committed Today for a Better Tomorrow RESOLUTION APPROVING INTERLOCAL AGREEMENT WITH THE CITY OF SANFORD AND LEASE AGREEMENT WITH PROGRESSIVE DEVELOPMENT COMPANY, LLC FOR THE CO -LOCATION OF COMMUNITY AND ECONOMIC DEVELOPMENT SERVICES AT THE SANFORD BUGGY FACTORY WHEREAS, the City of Sanford and Lee County Intergovernmental Relations Committee has developed a plan by which the various City and County Community and Economic Development departments and agencies will be co -located into one facility in order to increase efficiencies and effectiveness of all aspects of development for Sanford and Lee County; and, WHEREAS, along with the Sanford -Lee County Partnership for Prosperity ("SLCPP"), it is the intent of the City and County to co -locate the following departments and agencies: Community Development, Planning, Building Inspections, Code Enforcement, Downtown Sanford, Inc., Strategic Services (GIS), Environmental Health and Marketing; and, WHEREAS, Progressive Development Company, LLC has agreed to renovate and lease to the City, County and SLCPP portions of the Buggy Factory located at 115 Chatham Street for a 10 -year term at an agreed upon rate for the purpose of co -locating the above departments and agencies; and, WHEREAS, the Lee County Board of Commissioners and the Sanford City Council passed resolutions on June 16, 2014 and June 17, 2014, respectively, supporting the Buggy Factory location and directing city and county staff to develop the necessary agreements for approval by the County Commissioners and City Council; and, WHEREAS, pursuant to Chapters 153A and 160A of the North Carolina General Statutes and the lease agreement referenced above, city and county staff have developed an Interlocal Agreement for the shared rent and utility expenses associated with operation of city and county services at the Buggy Factory facility; and, WHEREAS, it is the desire of the Lee County Board of Commissioners to enter into an Interlocal Agreement with the City of Sanford for the payment of rent and utility expenses for the city and county departments located at the Buggy Factory; and, WHEREAS, it is the desire of the Board of Commissioners to lease the property described above, together with the City and the SLCPP, and subject to the Interlocal Agreement herein described. NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners as follows: 1. The Interlocal Agreement with the City of Sanford for shared use of the Buggy Factory is hereby approved.
