c>701(a- �O LEE COUNTY ,.ryk - Committed Today for a Better Tomorrow RESOLUTION AUTHORIZING THE SALE OF PROPERTY LOCATED AT 128-134 STEELE STREET IN SANFORD, NORTH CAROLINA WHEREAS, the County of Lee owns certain property located at 128-134 Steele Street, PIN number 9642-69-7614-00, in the City of Sanford, in Lee County, North Carolina, as shown on a deed recorded in Deed Book 01299, Page 0469, in the office of the Register of Deeds for Lee County, to which the record thereof reference is hereby made for more complete description; and, WHEREAS, North Carolina General Statutes §§ 153A-176 and 160A-269 permit the county to sell property by upset bid, after receipt of an offer to purchase the property; and, WHEREAS, the County of Lee proposes to dispose of the above described property as it is surplus to our needs; and, WHEREAS, the above -referenced property was conveyed to the County by Gift Deed from Paul O. Howard and his wife, Barbara James Howard; and, WHEREAS, the taxable value of the property is $604,000.00. WHEREAS, the County received an offer submitted by Brandon Atkins, on behalf of the Taboys Corporation ("Offeror"), to purchase the property described above in the amount of $10,000.00 plus any advertising costs; and, WHEREAS, Offeror has paid to the County Clerk the required 5 percent (5%) deposit on its offer; and, WHEREAS, at its regular meeting on October 3, 2016, the Lee County Board of Commissioners accepted the offer of $10,000.00 from Brandon Atkins on behalf of Taboy's Corporation and such offer was advertised in The Sanford Herald on October 5, 2016; and, WHEREAS, no further upset bids were received during the 10 -day upset bid period and the original offer form Brandon Atkins on behalf of Taboy's Corporation is the final and highest bid received. follows: NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners as 1. The Lee County Board of Commissioners hereby accepts the offer of $10,000.00 from Brandon Atkins on behalf of Taboy's Corporation. 2. The terms of the final sale are as follows: Buyer must pay with cash, cashier's check or certified check at the time of closing.
