026 <br />5.43.4.6 A wine shop shall not operate after 11:00 p.m. on Sunday, Monday, Tuesday, Wednesday, <br />and Thursday or after 12:00 a.m. on Friday and Saturday. <br />5.43.4.7 A wine shop shall not require a membership, cover or minimum charge for admittance or <br />service during regular or special periods of operation. <br />5.43.4.8 A wine shop in the HC, C-1, C-2, PUD, and TND districts shall not be located within two <br />hundred (200) linear feet of a parcel or tract of land that contains any church or religious institution, <br />daycare facility, or detached single-family dwelling structure. <br />5.43.4.9 The provisions of this section shall apply to all wine shops whether operated as a principal <br />or accessory use. <br />Section 3. That APPENDIX A. A-3 DEFINITIONS, be rewritten to include the following new <br />definitions: <br />WINE SHOP - A wine shop is an establishment conducted pursuant to G.S. 18B-1001 as <br />amended, and operated as a principal or accessory use, which is authorized to sell wine in the <br />manufacture's original container for consumption off the premises, provided however, the <br />permittee shall be authorized to conduct accessory and incidental wine tasting on the premises and <br />is further authorized to sell wine and malt beverages for on -premises consumption, as an accessory <br />and incidental use to the wine shop, provided the establishment and operation is compliant with <br />the supplemental regulations of Section 5.43.4. <br />Section 4. This ordinance shall be in full force and effect from and after the date of adoption. <br />Adopted this day of October 2016. <br />Amy M.
