020 <br />MEMORANDUM <br />TO: Lee County Board of Commissioners <br />John Crumpton, County Manager <br />FROM: Marshall Downey, Director Sanford/Lee Co. Planning & Development <br />DATE: October 3, 2016 <br />REF: Planning Board recommendation regarding proposed text amendments to the <br />Unified Development Ordinance <br />The following text amendments to the UDO were presented to the Board of Commissioners and <br />Planning Board at a joint public hearing on September 19, 2016. The amendments were <br />recommended for adoption by the Joint Planning Commission at their June 30, 2016 meeting. <br />Below is a brief summary of the amendments with the Planning Board's recommendation: <br />PROPOSED AMENDMENT to Article 4, Table 4.6-1 and Article 5, Supplemental <br />Development Regulations. <br />As stated at the public hearing, planning staff was approach by Mr. Ryan Elliott for a new business <br />in downtown Sanford that will retail wine and allow the on premise consumption of wine and malt <br />beverages. Upon review of the proposed business, staff determined that the use did not "fit" into <br />an existing land use category. Under the current regulations in the UDO, the proposed use would <br />be classified as an Entertainment Establishment. The business owner in conjunction with staff <br />made a presentation to the Joint Planning Commission for consideration of adding a new land use <br />category for "wine shops". The Joint Planning Commission voted unanimously to recommend an <br />amendment to the UDO to add a new use for "Wine Shops" with supplemental development <br />regulations. <br />The Planning Board by a majority vote recommend approval of the text amendments as <br />recommended by the JPC and as presented at the public hearing. Attached is the draft Ordinance <br />for consideration of adoption. <br />
