BK:00028 PG -0403 <br />AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP <br />OF THE LEE COUNTY, NORTH CAROLINA <br />WHEREAS, a request to amend the Official Zoning Map has been received from Toribo <br />Hernandez to rezone an 8.75+ acre portion of a larger 9.95+ acre tract of land off of Airport <br />Road, formerly addressed as 2917 Airport Road, as depicted on Lee County Tax Maps 9641.02 <br />and 9641.04, as a portion of Tax Parcel 9641-65-4298 Lee County Land Records from <br />Residential Agricultural (RA) district to a conditional zoning district to be known as Sanford <br />Soccer Field Complex District to allow for the development of a soccer field complex via a site <br />plan specific zoning district in addition to all land uses currently permitted in the Residential <br />Agricultural (RA) zoning district; and <br />WHEREAS, said request has been presented to the Lee County Planning Board; and <br />WHEREAS, the Lee County Board of Commissioners conducted a public hearing on June 20, <br />2016 to receive citizen input on the requested zoning map amendment; and <br />WHEREAS, the Lee County Board of Commissioners approves the request to amend the <br />Official Zoning Map of Lee County, North Carolina; <br />NOW, THEREFORE, BE IT ORDAINED BY THE LEE COUNTY BOARD OF <br />COMMISSIONERS: <br />The Official Zoning Map is hereby amended to rezone an 8.75+ acre portion of a larger 9.95+ <br />acre tract of land off of Airport Road, formerly addressed as 2917 Airport Road, as depicted on <br />Lee County Tax Maps 9641.02 and 9641.04, as a portion of Tax Parcel 9641-65-4298 Lee <br />County Land Records from Residential Agricultural (RA) district to a conditional zoning district <br />to be known as Sanford Soccer Field Complex District, with the following conditions: no alcohol <br />shall be served or consumed on site, signs shall be posted stating "no alcohol, no drugs, no <br />weapons and no loitering", security shall be provided at all nonpractice games and traffic control <br />must be provided for major events in Phases I and II. See attached map for reference. <br />In making this decision, the Board of Commissioners hereby finds that, while the 2020 Land Use <br />Plan did not specify a particular land use for this property, the request appears to be reasonable <br />and in the public interest based on information in the staff analysis and the conditional zoning <br />application and the location in an area near two public schools with a high volume of vehicular <br />and pedestrian traffic which suggest that this site is not conducive to continued single-family <br />residential development; therefore it appears that it is reasonable to develop this site in a manner <br />other than residential. <br />ADOPTED this the 15th day of August, 2016. <br />Amy/M.
