BK -00028 PG -0295 <br />INTERLOCAL AGREEMENT <br />WHEREAS, pursuant to N.C.G.S. Chapter 160A, Article 20, Part 1, this Interlocal Agreement (hereinafter <br />"Agreement"), is entered into by and between the Town of Broadway, a body politic and a municipal <br />corporation located in Lee County, NC (hereinafter "Town") and the County of Lee, North Carolina, a <br />body politic and corporate (hereinafter "County"); and, <br />WHEREAS, County is required by statute to provide rabies control and dangerous dog control <br />throughout the incorporated and unincorporated portions of the County; and, <br />WHEREAS, Town adopted County's Animal Control Ordinance; and, <br />WHEREAS, County wishes for Town to assist the Lee County Sheriff in enforcing the Animal Control <br />Ordinance inside the corporate limits of Town; and, <br />WHEREAS, Town and County wish to enter into an agreement to establish the basis for such assistance. <br />NOW THEREFORE, in furtherance of this agreement, Town and County agree to the following terms and <br />conditions: <br />1. TOWN DUTIES. Town Police Officer(s) shall provide enforcement of the Animal Control <br />Ordinance within the corporate limits of the Town of Broadway. <br />2. COUNTY DUTIES. County shall accept all after hours calls for incidents within Town limits <br />involving rabies control, dangerous dog control and enforcement of the Animal Control <br />Ordinance. <br />3. SALARIES AND BENEFITS. All salaries and associated benefits of Police Officer(s) working <br />pursuant to this agreement shall be paid by Town, including but not limited to health insurance, <br />local government retirement, etc. <br />4. WORKERS' COMPENSATION. Town will be responsible for and shall maintain Workers' <br />Compensation insurance for the Police Officer(s) conducting Animal Control Ordinance <br />enforcement pursuant to this Agreement. <br />5. COMPENSATION. For FY 2016-2017, County shall pay to Town $20,000 per annum for services <br />performed pursuant to this Agreement. <br />6. SUPERVISION. Town police officers working under this agreement shall be under the <br />supervision and control of the Town Police Chief. <br />
