BK -00028 PG- 0293 <br />5. COMPENSATION. Lee County shall pay Town $70,000 (seventy thousand dollars) for services <br />rendered pursuant to this Agreement. <br />6. WORKERS' COMPENSATION. Town will be responsible for and shall maintain Workers' <br />Compensation insurance for the Police Officers employed pursuant to this Agreement. <br />7. SUPERVISION. Town police officers working under this agreement shall be under the <br />supervision and control of the Town Police Chief. <br />The Town Police Chief and Sheriff may agree to more detailed policies and procedures for the <br />implementation and operation of this Agreement. If the Town Police Chief and Sheriff adopt <br />such supplementing policies, the policies and any amendments to such policies shall be attached <br />to this Agreement in each official repository. The Police Officers deputized pursuant to this <br />agreement, Sheriff and Town Police Chief shall conduct activities pursuant to this Agreement in <br />accordance with such policies that are not inconsistent with this Agreement. <br />8. SHERIFF'S AUTHORITY. Nothing herein shall limit the Sheriff's ability to directly provide, through <br />his department, law enforcement services to the service area. In addition, Sheriff may assume <br />incident command of any law enforcement activity occurring within the Service Area, including <br />activity involving Town Police Officers working under the terms of this Agreement. <br />9. FINANCE, INSURANCE. Town shall assume all risk and liability related to workers' compensation <br />and motor vehicle use and shall be responsible for any workers' compensation liability, <br />automobile liability, general law enforcement liability insurance and all other liability for services <br />provided in the Service Area pursuant to this Agreement. Except as might be required by law, <br />the Town, in accordance with current policies, shall, in its discretion, determine the means, <br />amount, scope and level of such claim response and/or insurance coverage. <br />10. VEHICLES. Town is responsible for purchasing, insuring and providing for use all vehicles used <br />pursuant to this Agreement. Town is further responsible for all maintenance, fuel costs and <br />replacement costs of all vehicles used pursuant to this Agreement. The Town shall bear the <br />responsibility, loss and/or right to negotiate, to sure, or to settle any claim or matter related to <br />damage to a vehicle which occurs during activity pursuant to this Agreement. <br />11. REAL PROPERTY. No real property shall be held or owned pursuant to this Agreement. <br />12. MUTUAL AID. This Agreement is supplemental to and is not meant to void, supersede or modify <br />any existing mutual aid agreement between the parties. <br />13. AMENDMENT, DURATION. This Agreement may be amended upon such terms and conditions <br />as the parties might agree to in writing. This Agreement shall be for one year and shall <br />automatically renew unless terminated pursuant to the terms contained herein. <br />
