BK:00028 PG -0292 <br />INTERLOCAL AGREEMENT <br />WHEREAS, pursuant to N.C.G.S. Chapter 160A, Article 20, Part 1, this Interlocal Agreement (hereinafter <br />"Agreement"), is entered into by and between the Town of Broadway, a body politic and a municipal <br />corporation located in Lee County, NC (hereinafter "Town"), the County of Lee, North Carolina, a body <br />politic and corporate, and Tracy L. Carter, in his official capacity as Lee County Sheriff, a governmental <br />law enforcement officer existing under the Constitution of North Carolina (hereinafter "Sheriff'); and, <br />WHEREAS, Sheriff is required to provide law enforcement services to the unincorporated areas of Lee <br />County, including the area to the North and East of the municipal limits of Town, as further described <br />herein; and, <br />WHEREAS, Sheriff and Town desire to enter into an agreement to provide police protection and law <br />enforcement services to the Service Area; and, <br />WHEREAS, Sheriff requests that Town allow its Police Officers to be appointed as Deputy Sheriffs to <br />provide law enforcement services and enforce the criminal laws of the State of North Carolina within the <br />Service Area; and, <br />WHEREAS, in furtherance of this agreement, Town and Sheriff agree to the following terms and <br />conditions: <br />1. DUTIES. Sheriff has appointed or will appoint various Town Police Officers as Deputy Sheriffs in <br />order to provide them with the appropriate law enforcement authorization in the Service Area <br />in furtherance of this agreement. Such deputized Police Officers will engage in law enforcement <br />and police protection activities in the Service Area, as further described herein. Town, through <br />its deputized Police Officers, will provide the same level of law enforcement services to the <br />Service Area as it does to the incorporated areas of the Town. <br />2. SERVICE AREA. The Service Area subject to this agreement shall include the unincorporated <br />area of Lee County, including but not limited to the area adjacent to and bordering the Town. <br />3. PERSONNEL. Town Police Officers under this Agreement are employees of Town. Town Police <br />Chief shall schedule all work assignments and be responsible for all employment-related <br />matters. In addition, Town Police Chief shall have daily operational control of all personnel <br />working in the Service Area under this agreement. <br />4. SALARIES AND BENEFITS. All salaries and associated benefits shall be paid by Town for services <br />provided under this contract, including but not limited to health insurance, local government <br />retirement, law enforcement officer supplemental retirement, etc. <br />
