BK:00028 PG -0219 <br />D. In the event the Attorney voluntarily resigns her position with the <br />County, the Attorney shall give the County thirty (30) days notice in <br />advance and she will not receive any severance pay or other several <br />related benefits enumerated in Section 3A above. <br />E. If Attorney is permanently disabled or is otherwise unable to perform <br />her duties because of sickness, accident, injury, mental incapacity, or <br />health for a period of four (4) successive weeks beyond any accrued <br />sick leave, or for twenty (20) working days over a thirty (30) working <br />day period, the County shall have the option to terminate this <br />agreement, provided the County shall continue to pay the Attorney her <br />then existing salary, together with all other benefits on the regular <br />payroll schedule of the Attorney, until the expiration of ninety (90) days <br />from the date of termination or expiration of her accumulated sick <br />leave, whichever is greater. However, Attorney shall be compensated <br />for any accrued vacation, holidays, or other accrued benefits except for <br />sick leave. <br />F. The County has determined and hereby declares that the final <br />compensation provided for above is in consideration of public service <br />to the County. <br />G. If the Attorney's employment is discontinued for any reason, including <br />by resignation or termination, County shall pay all salary, other <br />compensation, accrued vacation and other monies due the Attorney as <br />provided on or before the next regular pay day either through the <br />regular pay channels or by mail if requested by the Attorney. County <br />shall not insist on the performance of any act or execution of any <br />document by the Attorney as a precondition of payment of monies <br />owed. <br />Section 4. TRAVEL AND SUBSISTENCE <br />The County hereby agrees to budget for and to pay the travel and <br />subsistence of Attorney for professional and official travel and <br />meetings to continue the professional development of Attorney and to <br />adequately pursue necessary official and other functions for the <br />County, as approved in advance by the County Manager. Whenever <br />employee intends to travel out of the County on County business, <br />overnight or out of the State of North Carolina, she shall confer with the <br />Chairman of the Board of Commissioners prior to such travel. The <br />Attorney shall be entitled to receive reimbursement for any of her <br />reasonable out-of-pocket expenses incurred during attendance at any <br />conference, training, school or in-service training program, as well as <br />any and all reasonable out-of-pocket expenses incurred by the <br />4 <br />
