y l - <br /> employees the benefits mentioned in Paragraph I and the preamble of this <br /> Resolution. <br /> Upon motion of Kelly and seconded by Atkins, the above Resolution was <br /> introduced for passage and the same was duly passed, the following number <br /> voting in the affirmative; three (3) and the following number voting in the <br /> negative: none. " <br /> The Attorney thereupon presented the agreement which was then executed <br /> I by the Chairman of the Board and attested by the Clerk for and in behalf of <br /> said Board of Commissioners of Lee County, to-wit; <br /> "NORTH CAROLINA <br /> LEE COUNTY <br /> THIS AGREEMENT made and entered into on this the 27th day of May, 1957, <br /> by and between Board of Commissioners of the County of Lee, hereinafter <br /> referred to as the Political Subdivision, the party of the first part, and the <br /> Secretary of the Board of Trustees of the Teachers' and State Employees' <br /> Retirement System, hereinafter referred to as the State Agency, the party of <br /> the second part; <br /> WITNESSETH <br /> That the Political Subdivision, by virtue of the power and authority conferred <br /> upon it by its charter, by Chapter 160 of the General Statutes of North Carolina, <br /> as amended, or by virtue of Chapter 153 of the General Statutes of North <br /> Carolina, as amended, and by virtue of Article 2 of Chapter 135 of the General <br /> Statutes of North Carolina, as amended, for the purpose of extending to the <br /> policemen or other law enforcement officers of political subdivisions the basic <br /> protection afforded by the Old-Age and Survivors Insurance System embodied <br /> n the Social Security Act, has agreed with the State Agency for the purpose of <br /> establishing the plan as follows: <br /> 1. It is agreed that the State Agency is hereby authorized to include this <br /> Political Subdivision with respect to policemen or other law enforcement <br /> officers in any original Agreement, or any modification thereof, entered into <br /> between the State of North Carolina and the Secretary of Health, Education <br /> and Welfare of the United States pursuant to Section 218 of the Social Security <br /> Act and Article 2 of Chapter 135 of the General Statutes, as amended, and any <br /> other North Carolina enabling legislation. <br /> 2. It is agreed between this Political Subdivision and the State Agency that <br /> the Agreement of August 5, 1952, is hereby amended to include these services <br /> effective January 1, 1956. <br /> IN WITNESS WHEREOF, the Political Subdivision, by virtue of its <br /> authority as provided by law and by virtue of a resolution or -order duly passed <br /> by the governing authority of said Political Subdivision, a certified copy of <br /> which resolution or order is hereto attached, has caused these presents to be <br /> executed in its behalf by its Chairman or presiding Officer, whose signature <br /> appears below, and attested by its Clerk or Secretary, whose signature <br /> appears below; and further; <br /> IN WITNESS WHEREOF, THE State Agency has caused this Agreement to be <br /> signed by the Secretary of the Teachers' and State Employees' Retirement <br /> System as authorized by law and whose signature appears herein below <br /> attached to this Agreement or plan. <br /> Board of Commissioners of Lee County <br /> /s/ Percy Measamer <br /> Chairman <br />
