4. <br /> TO THE BOARD OF COMMISSIONERS OF LEE COUNTY: <br /> O WHEREAS, by an Act of the General Assembly of North Carolina, known <br /> as House Bill No. 1105, passed and ratified on June 12, 1957, it is <br /> provided that the Board of Commissioners may on its own motion or shall <br /> upon a petition to said Board signed by at leatt 15 per cent of the registered <br /> and qualified voters of Lee County at any time within one (1) year from the <br /> date of ratification of said bill, order an election to beheld on the question <br /> of whether County Alcoholic Beverage Control Stores may be operated in <br /> Lee County; and whereas, said Act of the General Assembly provides the <br /> manner in which the profits from said stores shall be used, if established; <br /> and whereas, the undersigned voters are of the opinion that the voters of <br /> Lee County should have an opportunity to vote on said question; <br /> "AND. WHEREAS, by an act of the General Assembly of North Carolina, <br /> known as House Bill No. 1106, ratified on June 12, 1957, it is provided that <br /> the Boatel of Commissioners of Lee County shall upon a petition to said <br /> Board signed by at lent 15 per cent of the registered, qualified voters of <br /> Lee County, at any time within one (1) year from the date of the ratification <br /> of this Act, order an election to be held on the question of whether or not <br /> beer and/or wine shall be sold within Lee County for take home or off <br /> premises consumption; and whereas, the said Bill provides that if the <br /> voters of Lee County ratify the legal sale of beer and/or wine in the County, <br /> said sales shall be made for take home or off premises consumption only; <br /> "AND WHEREAS, the undersigned believe that the voters of Lee County <br /> should be forthwith given an opportunity to vote on said questions as by law <br /> provided; <br /> " NOW, THEREFORE, the undersigned, being registered and qualified <br /> voters of Lee County, do hereby petition your Hmorable Body to call an <br /> election for Lee County and at said election submit to the voters of the <br /> County the following propositions: <br /> dt 1. Whether or not Alcoholic Beverage Control Stores shall be <br /> established and alcoholic beverages legally sold in Lee County. <br /> 2. Whether or not_beer shall legally be sold in Lee County, <br /> 3. Whether or not wine shall legally be sold in Lee County. <br /> tt Respectfully submitted this 1st day of July, 1957, <br /> Mr. Morris stated that it was his opinion that the petition contained <br /> the names of more than 900 registered and qualified voters of Lee County <br /> and that upon the passing of said petition it became the unqualified duty <br /> of the Board to call an election to determine whether Alcoholic beverages, <br /> beer and wine should be sold in Lee County. <br /> The petition was examined in detail by the members of the Board. Thereafter, <br /> Commissioner Ch shire moved that the Chairman be authorized to have <br /> the petition checko determine the validity of the signatures contained on <br /> said petition and to determine the sufficiency of the petition for the calling <br /> of an election in Lee County to submit to the qualified voters thereof the <br /> question as to whether or not alcoholic beverages, beer and wine should <br /> be legally sold in said county. This motion was seconded by Commissioner <br /> Winstead and the same was adopted by unanimous vote of the Board. <br />
