0 <br /> am returning the petition and advising the petitioners of the statutory <br /> requirements'for the calling of an election. The necessary signatures <br /> must be obtained in the event that they wish to pursue the matter further. <br /> It is my purpose, and I am sure that it is the purpose of this Board, to <br /> protect the public interest, and I feel that both sides should know that the <br /> law, as enacted by the 1957 General Assembly, sOecifically calls for a <br /> petition containing the signatures of 15 per cent of the registered qualified <br /> voters of Lee County. <br /> "Upon the advice of the County Attorney , I have asked Mr. W. H. Ray, <br /> Chairman of the Lee County Board of Elections for a determination of the <br /> number of "registered qualified voters of Lee County". Since the words <br /> "registered qualified voters" is a new term in election law phraseology, <br /> I haves asked for a clarification of its meaning. We cannot proceed <br /> with this or any subsequent petition until we know just what 15 per cent of <br /> the registered qualified voters means. . <br /> " I have talked with Mr. Ray about this matter and it now appears that <br /> approximately 1900 valid signatures will be required for calling of an election <br /> instead of the number of approximately 891 as would have been necessary <br /> under the General Statutes of North Carolina. . <br /> 'The omission of the qualifying words in the Special Lee County Statute <br /> was not discovered by Mr. Staton until Monday night after the original <br /> petition had been *submitted and this is the reason I take this opportunity <br /> of making a statement concerning these facts. <br /> "The Board is not taking sides in this matter. We are advised that the <br /> legal requirements must be complied with before any action can be taken <br /> on the petition by this Board." <br /> Thereafter various individuals who opposed the calling of an election <br /> to determine whether or not ABC Stores shoul4e established in Lee County <br /> and whether or not beer and wine shoulcte sol in Lee County, were heard <br /> in opposition to the petition. <br /> was <br /> No•formal action was taken by the Board and the Chairman/instructed <br /> to return the petition received at the regular meeting on Monday, July 1, <br /> 1957, to filace Mr. Morris and those other persons who had submitted the <br /> petition. <br /> There being no further business to come before the Board, upon motion <br /> duly made and seconded, the metting was adjourned. <br /> Chairman <br /> Clerk <br />
