Commissioner Winstead seconded the adoption of said <br /> substitute motion and the vote on the same was as follows: <br /> Commissioner Measamer - pass <br /> • Groce - aye <br /> " - • Winstead - aye <br /> " Atkins - aye • <br /> " Kelly - no . <br /> • <br /> The Chairman thereupon announced the adoption of said sub- <br /> ' stitute moti'on. . , <br /> Upon motion of Commissioner,Measamer, which motion was • • <br /> seconded by'Commissioner Winstead, the following•resolution was unanimously <br /> adopted by the Board, to-wit:' <br /> WHEREAS it has been brought to the attention of the Board by <br /> the County Attorney that in the case #26, 454, _entitled "State -vs- Otis <br /> Mills" and in' Case #26, 453, entitled "State -vs- 'Mames Erston Cameron" <br /> tried in the Lee County Criminal Court on the 26th day of July, 1960, that <br /> said defendants had been convicted of the' illegal possession for the purpose <br /> of sale of eighty cases of beer, the same being known as "liquor" under <br /> the provisions of G. S. 18- 13, and it appearing that under the orders of- <br /> said Court the said eighty cases of beer has been turned over to the Board <br /> for disposition•, as required by law; <br /> NOW, THEREFORE, under the provisions of G. S. 18- 16, it <br /> is hereby resolved that the Sheriff of Lee County,' or his duly authorized <br /> representatives be and he is hereby:authorized, directed and empowered to <br /> • sell said eighty Cases of beer to any legalized alcoholic Beverage Control <br /> Store within the State' of North Carolina or to any legalized establishment. . <br /> licensed to sell beer or malt beverages by the State of North Carolina <br /> said Sheriff of Lee County being hereby authorized, empowered and <br /> • directed to sell the same at the highest price to be obtained for the sale <br /> of the same in bulk as the same 'now is; <br /> BE IT FURTHER, RESOLVED that from the proceeds received, <br /> after paying the cost of,said. sale, said Sheriff shall turn over said funds <br /> ' to the auditor of 'Lee -Courity'for deposit in the School Fund as provided by <br /> law.
