Commissioner Winstead seconded the adoption of said substitute motion and the vote on the same was as follows: Commissioner Measamer - pass • Groce - aye " - • Winstead - aye " Atkins - aye • " Kelly - no . • The Chairman thereupon announced the adoption of said sub- ' stitute moti'on. . , Upon motion of Commissioner,Measamer, which motion was • • seconded by'Commissioner Winstead, the following•resolution was unanimously adopted by the Board, to-wit:' WHEREAS it has been brought to the attention of the Board by the County Attorney that in the case #26, 454, _entitled "State -vs- Otis Mills" and in' Case #26, 453, entitled "State -vs- 'Mames Erston Cameron" tried in the Lee County Criminal Court on the 26th day of July, 1960, that said defendants had been convicted of the' illegal possession for the purpose of sale of eighty cases of beer, the same being known as "liquor" under the provisions of G. S. 18- 13, and it appearing that under the orders of- said Court the said eighty cases of beer has been turned over to the Board for disposition•, as required by law; NOW, THEREFORE, under the provisions of G. S. 18- 16, it is hereby resolved that the Sheriff of Lee County,' or his duly authorized representatives be and he is hereby:authorized, directed and empowered to • sell said eighty Cases of beer to any legalized alcoholic Beverage Control Store within the State' of North Carolina or to any legalized establishment. . licensed to sell beer or malt beverages by the State of North Carolina said Sheriff of Lee County being hereby authorized, empowered and • directed to sell the same at the highest price to be obtained for the sale of the same in bulk as the same 'now is; BE IT FURTHER, RESOLVED that from the proceeds received, after paying the cost of,said. sale, said Sheriff shall turn over said funds ' to the auditor of 'Lee -Courity'for deposit in the School Fund as provided by law.
