BK:00028 PG -0181 <br />LEE COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION APPOINTING GARRIS NEIL YARBOROUGH AS <br />COUNTY ATTORNEY ON AN INTERIM BASIS <br />WHEREAS, North Carolina General Statute §153A -114 says "the board of commissioners shall <br />appoint a county attorney to serve at its pleasure and to be its legal advisor;" and, <br />WHEREAS, Lee County will be without a County Attorney as of April 1, 2016 due to the resignation <br />of County Attorney Kerry Self; and, <br />WHEREAS, the Board of Commissioners desires to hire a County Attorney on an interim basis until <br />the search for a new permanent attorney can be completed; and, <br />WHEREAS, the County Manager is recommending that the Board of Commissioners appoint Garris <br />Neil Yarborough and in his absence a member of Mr. Yarborough's law firm of Yarborough, Winters <br />& Neville, P.A.; and, <br />WHEREAS, Mr. Yarborough has previously served as the Lee County Attorney on an interim basis <br />after the passing of former County Attorney W. Dale Talbert; and, <br />WHEREAS, Mr. Yarborough and his firm have the necessary experience to serve as the Lee County <br />Attorney on an interim basis. <br />NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners, that Garris <br />Neil Yarborough be appointed as the Lee County Attorney on an interim basis, as described above. <br />With this appointment, the Board gives Mr. Yarborough the full authority to act as its attorney and to <br />advise staff on legal matters. <br />BE IT FURTHER RESOLVED, said appointment is to be effective as of April 1, 2016. <br />s-� <br />Adopted this t ee day of March, 2016. <br />Amy M.
