RECOMMENDATION OF THE PLANNING BOARD <br />FOR A CHANGE TO THE OFFICIAL ZONING MAP OF LEE COUNTY <br />APPLICATION 2014-0501 <br />The Planning Board by a unanimous vote recommends the Board of Commissioners approve <br />Application #2016-0301 submitted by Mr. Rand Schenck to rezone 14.45± acres of land on Deep <br />River Road from Highway Commercial Conditional Use (HC -CU) district to Highway <br />Commercial (HC) district. <br />LAND USE INFORMATION PRESENTED AT THE PUBLIC HEARING <br />Site and Area Description <br />The subject property is vacant and consists of 14.45± acres of land that is bordered by US <br />Highway 1 North, Deep River Road, and the Deep River. The site appears to be medium to <br />heavy wooded. <br />Land Uses and Existing Zoning <br />Land uses in the vicinity are low density residential uses. The residential uses are located south <br />of the tract along Lower Moncure Road. Zoning in the area consists of Residential Agricultural <br />(RA) in the southwest corner of Deep River Road and Lower Moncure Road and Heavy <br />Industrial (HI) zoning in the southeast corner of Deep River Road and Lower Moncure Road. A <br />3 -acre lot located diagonally across U S Highway 1 to the southwest is zoned Highway <br />Commercial and was formerly Culberson Trucking Company. Heavy Industrial Conditional Use <br />zoning exist in the area northwest of the site and west of US Highway 1 and is the location of <br />Wake Stone Rock Quarry. <br />Staff Analysis <br />The subject property was zoned to Highway Commercial Conditional Use District in 1990. At <br />that time the former owners were proposing to build a restaurant. The current owner is <br />marketing the property and is seeking to rezone it to allow all commercial uses permitted in the <br />Highway Commercial (HC) district. <br />The proposed Highway Commercial (HC) district is established to accommodate uses that <br />depend upon a large flow of traffic and convenient access, such as retailing of durable goods, the <br />provision of commercial services to industrial areas, and the provision of services to tourists. <br />The minimum dimensional standards in the HC district include a lot width of 50 feet, a front yard <br />setback of 10 feet, and 0 rear and side yard setbacks. (A list of uses allowed in the HC district is <br />attached for your reference) <br />Utilities: The subject property has access to public water via an 8" water main in the right-of- <br />way of Deep River Road. A private onsite septic system will be required for wastewater <br />disposal. <br />Emergency Response: The Deep River Fire District covers the area of the petitioned site. <br />
