015 <br />6. Inspection <br />Landlord, or its authorized agents, shall at any and all reasonable times, after three <br />(3) days' notice, have the right to enter the premises to inspect the same. <br />7. Taxes <br />Tenant shall be liable for all personal property taxes levied against leasehold <br />improvements, merchandise, personal property, trade fixtures and all other taxable <br />property located in the premises. <br />Landlord shall be liable for all real property taxes levied against the property. <br />S. Repairs and Maintenance <br />Tenant shall be responsible for the maintenance of the interior and the janitorial <br />service of the premises. <br />Landlord shall be responsible for all structural, mechanical, plumbing and exterior <br />maintenance, including but not limited to maintenance of windows, doors and door <br />mechanisms, HVAC, fire suppression system and annual inspection of backflow <br />prevention, toilet facilities, roof, and gutters. Landlord shall be further responsible <br />for landscaping, if any, and all parking lot repairs and maintenance. <br />9. Tenant Damages <br />Tenant shall not allow any damage to be committed on any portion of the premises <br />or property, and upon termination of this lease, Tenant shall deliver the premises to <br />Landlord in as good condition as existed at the commencement date of this Lease, <br />ordinary wear and tear excepted. The cost and expense of any repairs necessary to <br />restore the condition of the premises shall be borne by Tenant. <br />10. Force Majeure <br />If the leased premises are destroyed by fire or other casualty without fault of the <br />Tenant, this lease shall immediately terminate and the rent shall be apportioned to <br />the time of the damage. If the premises are only partially destroyed or damaged by <br />fire or other casualty without fault of the Tenant so as to render the premises <br />unusable in whole or in part, the rent shall be apportioned until the premises are <br />repaired. <br />11. Payment <br />Other remedies for nonpayment of rent notwithstanding, if any payment of rent or <br />additional rent is not received by Landlord on or before the fifth (5th) day of the <br />month for which the rent is due, or if any other payment hereunder due Landlord by <br />Tenant is not received by Landlord on or before the fifth (5th) day of the month next <br />following the month in which Tenant was invoiced, Tenant shall also pay (a) a late <br />payment charge of ten percent (10%) of such past due amount, and (b) interest of <br />eighteen percent (18%) per annum or the maximum then allowed by applicable <br />laws, whichever is less, on the remaining unpaid balance, retroactive to the date <br />originally due until paid. <br />
