BK -00027 PG -0945 <br />Aye: Dalrymple, Frazier, Knecht, Oldham, Reives, Sloan, and Smith <br />Nay: None <br />The Chair ruled the motion had been adopted unanimously. <br />Pursuant to N.C. General Statute §153A-52.1, Chair Dalrymple opened the floor for Public <br />Comments. The following signed up to speak and were allowed 3 minutes for comments: <br />Terica Luxton, 3616 Lee Avenue, Sanford <br />The Board considered the second reading of a Resolution to Amend Chapter 2, Article III of the <br />Lee County Smoking Ordinance. Health Director Terrell Jones stated that in 2008 the Board of <br />Commissioners passed an Ordinance prohibiting the use or smoking of tobacco products in county <br />government buildings and/or vehicles. Since 2008, the State has changed the language pertaining to <br />the location in which smoking is prohibited, as well as the definitions and penalties that are allowed to <br />be imposed by local governments. A public hearing was held on November 2, 2015 with no one <br />speaking for or against the amendments. It was noted the amended Ordinance, if approved, will <br />prohibit smoking (to include e—cigarettes) on all county property, including county parks and <br />recreational facilities and areas, along with county buildings and county vehicles. After discussion, <br />Commissioner Reives moved to approve the Resolution Amending Chapter 2, Article 111 of the Lee <br />County Code of Ordinance Concerning the Use or Smoking of Tobacco Products in County <br />Government Buildings, Vehicles and on County Property, and for the County Manager and Health <br />Director to designate a smoking area for staff and the public if they so desire, a copy of which is <br />attached to these Minutes and by this reference made a part hereof. Upon a vote, the results were as <br />follows: <br />Aye: Dalrymple, Frazier, Knecht, Oldham, Reives, Sloan, and Smith <br />Nay: None <br />The Chair ruled the motion had been adopted unanimously. <br />The Board considered an appointment to the Juvenile Crime Prevention Council (JCPC). Clerk <br />to the Board Gaynell Lee stated a vacancy had occurred on the JCPC for a member from the area <br />mental health, development disabilities, and substance abuse authority. The Sandhills Center has <br />recommended Ms. Laurie Perez serve as designee for that organization. It was noted that Ms. Perez <br />lives out of county and will require approval of the Board to serve in said capacity. Commissioner <br />Smith moved to waive the Boards' Policy on out -of -county residents serving on Lee County Boards. <br />Commissioner Oldham stated he would like to table the appointment for 30 days and try to locate a Lee <br />County individual to serve. After discussion, the results of Commissioner Smith's motion were as <br />follows: <br />Aye: Dalrymple, Frazier, Knecht, Oldham, Reives, Sloan, and Smith <br />Nay: None <br />The Chair ruled the motion had been adopted unanimously. <br />Commissioner Smith moved to accept the application from Ms. Laurie Perez to serve on the Juvenile <br />Crime Prevention Council as presented.
