603 <br />• Pg of 4 <br />Application 2070-0201 Wake Stone <br />ne <br />Staff Analysis and Information <br />The subject property is zoned Residential Agicultural (RA) distract. Mining and Quarry operations <br />are permitted in the RA district as a Special Use upon issuance of a special use permit by the Board <br />of Adjustment. Instead of applying for a Special Use Permit, Wake Stone Corporation chose to <br />apply to rezone to HI-Conditional Zoning district to be consistent with the zoning and uses of their <br />current operation. More specifically, the applicant is requesting the conditional zoning district to <br />allow quarrying and muting operations on the 35.78-acre tract that will include an open pit <br />excavation, stone crushing and processing, protective berm construction, a new office/scale house <br />and a new entrance/exit driveway. <br />The Residential Agricultural district is established to provide areas for low density single-family uses, <br />low intensity agricultural operationas as well as agri-business and supportive industrial and <br />commercial ues. Some of the special uses that may locate in the RA district if granted a Special Use <br />Permit include golf courses, campgrounds, sports stadiums, arenas, and zoos. The dimensional <br />requirements of the RA district include a minimum lot size of 40,00 square feet (92 acs.) and <br />principal building setbacks of 30 feet front yard, 30 feet rear yard and 15 feet side yards. <br />The Heavy Industrial District is designed to accommodate those industries whose normal operations <br />include dust, noise, odor, or other emissions, which may be deemed objectionable. The HI district <br />• requires a minimum front building setback of 30 feet and 0 rear and 0 side yard setbacks. <br />Conditional Zoning District <br />The applicant is applying to rezone to a Conditional Zoning District, Type 2. A Type 2 is defined as <br />a conditional zoning district created for the purpose of allowing a property owner to place additional <br />conditions upon an existing, equivalent conventional, general use zoning district. The Conditional <br />Zoning District Type 2 would be the preferred zoning approach if a petitioner desired to (a) to <br />reduce or narrow the number of permitted uses and/or (b) impose higher level design standards <br />than that which exists within an equivalent general use zoning district. Conditional Zoning District <br />Type 2 would also be practical in situations where a petitioner desires to install or construct <br />additional buffers or other physical features that would serve to increase the protection afforded <br />neighboring properties and/or the appearance of the proposed development. <br />The application for conditional zoning district shall include a detailed site plan and narrative text <br />specifying the conditions that will govern the development and use of the property. If approved, <br />the site would be required to developed in accordance with design standards listed in the application <br />and illustrated on the site plan. <br />As a conditional zoning request, the Board of Commissioners and/or Planning Board may request <br />of the applicant that certain conditions be considered, however, the applicant must accept such <br />conditions before inclusion in the conditional zoning district. Any conditions shall be perpetually <br />binding upon the property included in the Conditional Zoning District. <br />• <br />
