ADMINISTRATION Secs. 2-32-2-50. Reserved. ARTICLE 111. USE OR SMOKING OF TOBACCO IN COUNTY GOVERNMENT BUILDINGS OR VEHICLES* Sec. 2-51. Definitions. [The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:] County government building means any building that is either owned by the county or is leased by the county as lessor; or is leased by the county, as lessee or any area in a building leased by the county as lessee and Is occupied by the county_ *Editor's note—Sections 1-3 of an ordinance adopted Sept. 15, 200% did not specify manner of inclusion; hence, codification as art. III, §§ 2-51- 2-53 -51- 2 53 was at the discretion of the editor. 024 § 2-53 Grounds means the area located within 50 linear feet of a building wherein one or more components of the Lee County Health Department or one or more components of the Lee County Department of So- cial Services are housed. Public transportation vehicles means vehicles owned or teased by the county and used by the public. Smoke means the use or possession of a lighted cigarette, lighted agar, righted pipe, or any other lighted tobacco product. Tobacco products means any product that con- tains tobacco and is intended for human use or consumption. (Ord. of 9-15-2008(3), § 1) Sec. 2-52. Areas where smoking and use of to- bacco products is restricted. (a) The interior space of all county government buildings is declared to be restricted areas in which no individual Is permitted to smoke or use tobacco products. (b) The ground around a building wherein a com- ponent of either the Lee County Health Department or the Lee County Department of Social Services is housed is declared to be a restricted area in which no individual is permitted to smoke or use tobacco prod- ucts. (c) The interior space of all public transportation vehicles is declared to be restricted areas in which no individual is permitted to smoke or use tobacco products. (Ord. of 9-15-2008(3), § 2) Sec. 2-53. Enforcement and penalties. (a) Employees who violate this article may be subject to sanctions consistent with the county's personnel policies in addition to the punishment for the infraction. (b) Employees and others who violate the provi- sions of this article are punishable for an infraction. (c) Any one found responsible for an infraction of the article shall for the first infraction pay a penalty of $25.00 and the costs of court; for a second infraction of this article a penalty of $50.00 and the costs of Supp. No. 5 CD2:3
