A. <br />Information <br />Meeting Date: November 16, 2015 XX Action Item <br />Consent Agenda <br />SUBJECT: Consider Resolution and Second Reading to Amend Chapter 2, Article III of the <br />Lee County Code of Ordinances Concerning the Use or Smoking of Tobacco Products in County Government <br />Buildings, Vehicles and on County Property <br />DEPARTMENT: Health Department <br />CONTACT PERSON: Terrell Jones, Health Director <br />REQUEST: Consider Resolution to Amend Smoking Code of Ordinance <br />SUMMARY: In 2008 the Board of Commissioners passed an Ordinance that prohibited the use <br />or smoking of tobacco products in county government buildings and/or vehicles. Since 2008, the State has <br />changed the language in NCGS §130A-498, including changing the locations in which smoking is prohibited, <br />as well as the definitions and penalties that are allowed to be imposed by local governments. The Health <br />Department requests the Board revise the language in the County's existing Ordinance to include e -cigarettes <br />in the definition of tobacco products. In addition, the Board should consider modifying the locations in which <br />smoking and use of tobacco products is prohibited and amend the definitions and penalties so as to comply <br />with said statute. <br />A public hearing was held on November 2, 2015 with no one speaking for or against the amendments. <br />Please note: If the amended ordinance is passed as it is currently written, smoking or use of tobacco <br />products will be prohibited on all county property, including county parks and recreational facilities <br />and areas. The Board will need to decide if it wants to prohibit smoking in such areas and, if not, it <br />needs to instruct staff as to the specific areas in which it does wish to prohibit smoking. <br />BUDGET IMPACT: N/A <br />ATTACHMENT(S): 1) Resolution; 2) NC General Statute §130A-498; 3) current Chapter Two, Article III <br />PUBLIC HEARING: No <br />PRIOR BOARD ACTION: See Above Summary <br />RECOMMENDATION: Approve Second Reading and Resolution to Amend the Smoking Ordinance as <br />presented <br />
