d61�-- 3� <br />LEE COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION TO REPEAL SECTION 4-46(a)(1) OF THE LEE COUNTY CODE OF <br />ORDINANCES CONCERNING SHELTER FOR EQUINE AND DOGS <br />WHEREAS, pursuant to N.C. General Statute § 153A-121, the County possesses general ordinance - <br />making authority to enact ordinances for the health, safety, or welfare of its citizens and the peace and <br />dignity of the county; and, <br />WHEREAS, Session Law 2015-192 (House Bill 553) states that "no county ordinances may regulate <br />the standards of care for farm animals;" and, <br />WHEREAS, such Session Law further defines "standards of care for farm animals" as the <br />"construction, repair, or improvement of farm animal shelter or housing," and includes equine within the <br />definition of "farm animals;" and, <br />WHEREAS, as previously passed by the Lee County Board of Commissioners, Section 4-46(a)(1) of <br />the Lee County Code of Ordinances states that the "proper shelter for an equine shall have a roof and at <br />least three sides sufficient to prevent exposure to the elements;" and, <br />WHEREAS, under Session Law 2015-192, the County can no longer regulate standards of care for farm <br />animals; and, <br />WHEREAS, it is necessary for the Board of Commissioners to repeal Section 4-46(a)(1) in order to <br />comply with state law. <br />NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners that Section <br />4-46(a)(1) is hereby repealed, effective as of the date of this resolution. <br />Adopted thi.1__� day of /���,<,,,, ,,� , 2015. <br />ATTEST: <br />ayn It M.
