BK -00027 PG: 0847 <br />TRANSPORTATION AGREEMENT <br />THIS AGREEMENT, as set forth herein between Lee County Senior Services, the <br />proponent agency, (hereinafter referred to as LCSS), for the County of Lee Transit <br />System, (hereinafter referred to as COLTS), and Central Carolina Community <br />College/ Life Long Learning Center, 1105 Kelly Drive, Sanford, N.C. 27330, <br />(hereinafter referred to as the Agency), represents a mutual understanding and <br />agreement whereby LCSS will provide to the Agency certain services as set forth <br />below. <br />1. Purpose <br />The purpose of this Agreement is to provide efficient and effective specialized <br />transportation for clients of the Agency with local and out -of -county transportation <br />service as a part of LCSS's coordinated transportation system. <br />2. Obligation of The Parties <br />A. LCSS shall: <br />1. Be responsible for the administration of the program. <br />2. Agree to keep and maintain good and proper business records of all services <br />and charges provided for under this Agreement. The source of those records <br />shall be information supplied by the Agency and LCSS. <br />3. Make all books and records maintained by LCSS pertaining to this Agreement <br />available to the Agency or its representatives for the purpose of inspection or <br />audit during normal business hours and upon reasonable notice. <br />4. Submit to the Agency, on or above the fifth (5`h) working day of each month, a <br />statement based on the rates set forth hereinafter as the rates at which the <br />Agency must reimburse LCSS for the costs of transportation services rendered <br />to or for said Agency during the previous month. Within said monthly <br />statement, LCSS will provide a report of the total number of clients transported <br />for the Agency and number of trips plus destinations traveled by Agency <br />clients. <br />5. Every effort will be made to provide transportation on an emergency non- <br />medical basis. <br />6. Disruptive Behavior: A passenger's right to transportation can be terminated <br />by COLTS due to misconduct of the passenger. Disruptive or abusive behavior <br />to other passengers or the driver will not be tolerated. EXAMPLES — <br />profanity, possession of weapons, eating, drinking, smoking, loud talk or <br />
