G3G
LEE COUNTY PARKS AND RECREATION
DATE: 05/06/2002
TO: MR WILLIAM COWAN, MANAGER
CC MR ED PASCHAL, COMMISSIONER
FROM: PA`T[ /
ATKIWS ANI FAMILY PARK
VENDORS
RE--
Commissioner Paschal carne by my office this morning and shared an e-mail that Gaynelle
received from Mrs. Chalmers concerning vending of goods in Kiwanis Family Pads. The Lee County
Parks and Recreation Commission took up this issue some time back. The board determined that
vending should not be allowed in the pads for a number of reasons. Prior to the board's action, I
had given permission to a Mr. Ezzell who is confined to a wheel chair permission to vend canned
drinks and packaged snacks in the park
Since the' action taken by the board, I have posted bilingual signage and have personally
instructed four or five vendors that they could not vend goods in the park I personally spoke with
Mr. Ezzell and Mr. Chalmers concerning the board's actions.
I spoke with Mr. Chalmers on the phone Friday May 3, 2002 and told him that vending was not
allowed. He said that vendors were still setting up in the park I told him that when parks and
recreation staff observed this activity that staff would ask the vendors to leave.
I called Mike Hanes at the health department because there has been a vendor in the park selling
prepared foods. I have spoken with the police department in the past concerning this issue as well.
The ordinance is contained in Sec. 18-38 paragraph (a) of the Lee County Code-
As I told Mr. Chalmers on Friday, the department does not have the resources to monitor the
park throughout the day- However, when vendors are observed in the pads, they will be asked to
leave. If they refuse to leave, the police will be called to have them removed.
IWP
