(Ord. of 8-24-78, § 1) Secs. 18-64-18-95. Reserved. ARTICLE III. LIGHTED ATHLETIC FIELDS Sec. 18-96. Purpose and statutory authority of article. The purpose of this article is to regulate the use of lighted athletic fields owned by, leased to or under the control of the county and utilized in programs under the supervision of the county parks and rec- reation department. This article is adopted pursuant to the authority contained in G.S. 153A-121 and 153A-169. This article applies to all such facilities located in the county. (Ord. of 6-16-97(2), § 1) Sec. 18-97. Penalty for violation of article. Any person violating this article shall be punished according to section 1-7. (Ord. of 6-16-97(2), § 6) Sec. 18-98. Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Athletic field means an area adapted to use for the playing of games and athletic events which is illumi- nated for such use during the hours of darkness. This is to include, but may not be limited to, Horton Park, O. T. Sloan Park, Temple Ballpark, Buchanan Park, Dalrymple Park, Lions Park and Optimist Park. Department means the county parks and recre- ation department. § 18-101 Director means the person employed by the county manager as interim, acting, provisional or permanent director of the county parks and recreation depart- ment. No person shall turn on or activate the lights at a parks and recreation department athletic field with- out the written authorization of the director. (Ord. of 6-16-97(2), § 3) Sec. 18-100. Use of facilities after midnight. No person shall play on or participate in an ath- letic event, or otherwise use a parks and recreation department athletic field, after 12:00 midnight with- out the written authorization of the director. No person shall tamperwith, injure, damage, break or destroy any part of the device used to activate the lights at any parks and recreation department ath- letic field.
