A. _ Information Meeting Date: February 1, 2010 XX Action Item - Consent Agenda SUBJECT: Request from Curtis Ezell to Sell Vending Products at Kiwanis Park DEPARTMENT: Administration/ Parks and Recreation CONTACT PERSON: John Crumpton/John Payne REQUEST: Mr. Curtis Ezell is requesting that the County Commissioners give him permission to sell vending items at Kiwanis Park SUMMARY: Mr. Curtis Ezell was originally given permission to sell vending items by Parks and Recreation Director John Payne about 5 years ago. Permission was granted after the County was approach by District Court Judge Christian to allow Mr. Ezell to sell these items. Last year, after several complaints concerning other vendors setting up in the parks, the permission was taken away. The County has an ordinance (Sec. 18-38) against this type of activity and to enforce the ordinance equally all vending had to stop. For Mr. Ezell to be allowed to begin selling the items again the Commissioners would have to either change the ordinance or develop a License that would allow Mr. Ezell to be the sole provider of these services at Kiwanis Park. The ordinance allows for the department to issue a License, but no rules are in place. BUDGET IMPACT: N/A ATTACHMENT(S): 1) Parks and Recreation Ordinance 2) Letter from Mr. Payne to Mr. Ezell PUBLIC HEARING: N/o PRIOR BOARD ACTION: N/A RECOMMENDATION: Refer matter to the Parks and Recreation Advisory Board and ask them to review section 18-38 of the Parks and Recreation Ordinance and make recommendations on the wording of this section and develop Licensure rules for vending at all Parks if they see this as a viable activity.
