A. <br />_ Information <br />Meeting Date: February 1, 2010 XX Action Item <br />- Consent Agenda <br />SUBJECT: Request from Curtis Ezell to Sell Vending Products at Kiwanis Park <br />DEPARTMENT: Administration/ Parks and Recreation <br />CONTACT PERSON: John Crumpton/John Payne <br />REQUEST: Mr. Curtis Ezell is requesting that the County Commissioners give him <br />permission to sell vending items at Kiwanis Park <br />SUMMARY: Mr. Curtis Ezell was originally given permission to sell vending items by <br />Parks and Recreation Director John Payne about 5 years ago. Permission was granted after the <br />County was approach by District Court Judge Christian to allow Mr. Ezell to sell these items. Last <br />year, after several complaints concerning other vendors setting up in the parks, the permission <br />was taken away. The County has an ordinance (Sec. 18-38) against this type of activity and to <br />enforce the ordinance equally all vending had to stop. For Mr. Ezell to be allowed to begin selling <br />the items again the Commissioners would have to either change the ordinance or develop a <br />License that would allow Mr. Ezell to be the sole provider of these services at Kiwanis Park. The <br />ordinance allows for the department to issue a License, but no rules are in place. <br />BUDGET IMPACT: N/A <br />ATTACHMENT(S): 1) Parks and Recreation Ordinance <br />2) Letter from Mr. Payne to Mr. Ezell <br />PUBLIC HEARING: N/o <br />PRIOR BOARD ACTION: N/A <br />RECOMMENDATION: Refer matter to the Parks and Recreation Advisory Board and ask them <br />to review section 18-38 of the Parks and Recreation Ordinance and make recommendations on <br />the wording of this section and develop Licensure rules for vending at all Parks if they see this as <br />a viable activity. <br />
