G 0 6 <br />The Chairman ruled the motion had been adopted unanimously. <br />• Mr. Surface stated that Lee County had received an increase of $8,343 from the State in Family <br />Planning Program funds. If approved, funds would be administered through the Coalition for Families <br />of Lee County (Sister Love Family Planning program). Funds will be disbursed in equal payments to <br />the Coalition thru the end of the fiscal year. Commissioner Oldham moved to approve the acceptance <br />of $8,343 in Family Planning Program funds. The stated funds will be allotted to the H1N1 budget. <br />Commissioner Oldham moved to accept the balance of $18,678 for H1N1 funds from the State. Mr. Surface stated by February <br />1, 2010, he wished to have a WIC satellite office at The Broadway Library one day a week. The plan is <br />to increase services to two days a week by the first~of March 2010. A part-time staff person or a grad <br />student from UNC will be hired to admit terr the program. Tax Administrator <br />Dwane Brinson stated that the North Carolina Department of Revenue (NCDOR) assesses all public <br />utility companies on an annual basis. Just as local businesses list their property with the county during <br />the month of January, public utility companies must list their property with the NCDOR by March 31st of <br />each year. Mr. Brinson stated that Windstream failed to list its personal property during the listing <br />period. The NCDOR, being responsible for assessing public utility companies, assessed this company <br />with the necessary penalty as prescribed by law. Although NCDOR assesses this property, the penalty <br />under appeal would be collected and retained by Lee County. The penalty for Lee County and fire <br />districts totals $30,976.11. Windstream representative John Phillips spoke on behalf of Windstream <br />and discussed how the company filed extensions in all states except North Carolina (which was an <br />oversight on their part). Mr. Phillips asked the Commissioners to consider a $6,000 penalty instead of <br />the $30,976.11 penalty. Commissioner Reives moved to accept the recommendation of the Tax <br />• Administrator to deny relief of penalty from discovery for Windstream North Carolina, LLC in the amount <br />of $30,976.11.
