BOOK 23 PAGL325 <br />AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP <br />OF LEE COUNTY, NORTH CAROLINA <br />WHEREAS, a request to amend the Official Zoning Map has been received from Wake Stone <br />Corporation (Case#2010-0201) to rezone 35.78± acres of land that consist of three tracts and a <br />portion of a fourth tract located north of Deep River Road and adjacent to Wake Stone's <br />Moncure Quarry at 9725 Stone Quarry Road from Residential Agricultural (RA) and Heavy <br />Industrial Conditional Use (HI-CU) zoning districts to Heavy Industrial Conditional Zoning (HI- <br />C) Type 2 district. The property is the same as depicted on Tax Maps 9677, 9677.02, 9678, and <br />9668.04, all of Tax Parcels 9667-88-5704, 9667-98-1178, 9677-09-0108 and a portion of 9668- <br />90-3134, Lee County Land Records Office. <br />WHEREAS, said request has been presented to the Lee County Planning Board; and <br />WHEREAS, the Lee County Board of Commissioners conducted a public hearing on February <br />15, 2010 to receive citizen input on the requested zoning map amendment; and <br />WHEREAS, the Lee County Board of Commissioners approves the request to amend the <br />Official Zoning Map of Lee County, North Carolina; <br />NOW, THEREFORE, BE IT ORDAINED BY THE LEE COUNTY BOARD OF <br />COMMISSIONERS: <br />The Official Zoning Map is hereby amended to rezone 35.78± acres of land that consist of three <br />tracts and a portion of a fourth tract located north of Deep River Road and adjacent to Wake <br />Stone's Moncure Quarry at 9725 Stone Quarry Road from Residential Agricultural (RA) and <br />Heavy Industrial Conditional Use (HI-CU) zoning districts to Heavy Industrial Conditional <br />Zoning (HI-C) Type 2 district.. See attached map for reference. <br />The Lee County Board of Commissioners also finds that because this request is a conditional <br />zoning request the following uses shall be allowed in the Heavy Industrial Conditional Zoning <br />(HI-C) Type 2 district: <br />General/Design Conditions: The site shall be developed in accordance with the design <br />standards listed in the application and illustrated on the site plan (Exhibit A). The site shall also <br />meet all of the supplemental development regulations of Article 5, Section 5.23-Mining and <br />Quarries, Sub-Section 5.23.2-Standards with the exception of 5.23.2.4 which requires the <br />excavated area to be surrounded with a six-foot high security fence. In lieu of the six-foot <br />security fence, the applicant shall provide protection barriers as required by the Mine Safety and <br />Health Administration (MSHA). <br />Land Uses Permitted: Land uses within the Heavy Industrial Conditional Zoning (HI-C) Type 2 <br />district shall be the same as that which is allowed in the conventional Heavy Industrial (HI) <br />zoning district. A copy of Table 4.6-1 from the Unified Development Ordinance is attached <br />(Exhibit B) which illustrates what land uses are permitted within the Heavy Industrial zoning <br />district. <br />
