041 <br />5.41.3.5 Exhaust from any internal combustion engine or compressor, stationary or <br />mounted on wheels, used in connection with the drilling of any well or for use on any production <br />equipment shall not be discharged into the open air unless equipped with an exhaust muffler, or <br />mufflers or an exhaust muffler box constructed of noncombustible materials sufficient to <br />suppress noise and disruptive vibrations and prevent the escape of obnoxious gases, fumes or <br />ignited carbon or soot. <br />5.41.3.6 All drilling and production operations shall be conducted in such a manner as to <br />minimize, dust, vibration, or noxious odors. All equipment used shall be constructed and <br />operated so that vibrations, dust, odor or other harmful or annoying substances or effects are <br />minimized by the operations carried on at any drilling or production site or from anything <br />incident thereto to avoid injury to or annoyance of persons living in the vicinity. The site or <br />structures shall not be permitted to become dilapidated, unsightly or unsafe. <br />5.41.3.7 Exterior lightning shall be designed and installed such that all lighting is directed <br />inward to the well pad area and travel areas and creates minimum impact on surrounding <br />properties. <br />5.41.4 OIL OR GAS WELL PLUGGING AND ABANDONMENT BOND. <br />5.41.4.1 When oil or gas wells are to be plugged or abandoned, the permittee (person or <br />corporation to whom the North Carolina Department of Environment and Natural Resources has <br />issued an oil or gas well permit) shall submit to the jurisdiction having zoning authority an oil or <br />gas well plugging and abandonment bond in the amount of five thousand dollars ($5,000) plus <br />one dollar ($1.00) per linear foot as drilled for the permitted oil or gas well. <br />5.41.4.2 The process for abandonment or permanent plugging of an oil or gas well shall <br />comply with 15A North Carolina Administrative Code 05H .1618 as well as the reclamation <br />rules as set forth in 15A North Carolina Administrative Code 05H .2100. <br />5.41.4.3 The permittee may request this bond to be released when final site reclamation is <br />completed in accordance with 15A North Carolina Administrative Code 05H .2100 and for <br />which the oil or gas well is permanently plugged and abandoned in accordance with 15A North <br />Carolina Administrative Code 05H .1618. Determination of final site reclamation shall be under <br />authority of the North Carolina Department of Environment and Natural Resources. <br />
