C► 4 0 <br />Attachment 3. Amendment to Article S — New Supplemental Design <br />Standards for Oil and Gas extraction <br />Amend Article 5 to add new supplemental standards for Oil and Gas extraction/mining. This <br />sets up supplemental standards that include local regulations that supplement the State rules. <br />5.41.1 APPLICABILITY <br />This section applies to properties engaged in the surface extraction of subsurface petroleum, <br />shale oil and/or natural gas. Activities include exploration for crude petroleum and natural gas; <br />drilling, completing, and equipping wells; operation of separators, emulsion breakers, de -silting <br />equipment, and field gathering lines; storage yards and other related mining activities. This <br />category includes establishments that produce crude petroleum, that mine and extract oil from <br />shale, that produce natural gas, and that recover hydrocarbon liquids from oil and gas field gases. <br />5.41.2 COMPLIANCE WITH STATE REGULATIONS. All oil and gas extraction <br />operations shall maintain compliance with North Carolina Administrative Code Title 15A, <br />Subchapter 5H Oil and Gas Conservation (as amended). <br />5.41.3 ADDITIONAL STANDARDS. <br />5.41.3.1 Minimum well pad area is five (5) acres. Well pad shall include the area that is <br />cleared or prepared for the drilling of one or more oil or gas wells. The minimum acreage for the <br />well pad area shall be calculated based on total cumulative acreage assembled via ownership or <br />lease across one or more parcels. <br />5.41.3.2 Such uses shall have direct access to a paved publicly maintained street with a <br />minimum 50 foot right-of-way. Such access shall be connected via an all-weather surface <br />constructed and maintained in accordance with Section 15A NCAC 05H.1503 (as amended). <br />5.41.3.3 Where abutting residentially zoned or developed parcels, the well pad area shall <br />be screened with a Type D screening buffer yard as set forth in Article 7. <br />5.41.3.4 Only one (1) ground sign per entrance to the well pad is permitted. Such sign <br />shall not exceed fifty (50) square feet in area. If lighted, such sign may include indirect lighting <br />or non -flashing illumination. Such sign shall also conform to the requirements of Section 15A <br />NCAC 05H .1615 (as amended). <br />
