MEMORANDUM <br />TO: Lee County Board of Commissioners <br />Lee County Planning Board Members <br />John Crumpton, County Manager <br />FROM: Marshall Downey, Planning Director <br />DATE: July 13, 2015 <br />\yRRTERED <br />REF: Public hearing regarding changes to the Unified Development Ordinance <br />relating to Mining and Quarries <br />You are likely aware of the NC General Assembly's passage of the The Clean Energy and <br />Economic Security Act of 2012 that reconstituted the state's Mining Commission as the N.C. <br />Mining and Energy Commission. The law charged the Commission, in conjunction with <br />other state agencies and commissions, with developing a modern regulatory program for the <br />management of oil and gas exploration and development activities in North Carolina, <br />including the use of horizontal drilling and hydraulic fracturing ("fracking"). <br />Triassic Basins of North Carolina <br />}--------- <br />r <br />Ienbu rn <br />J -i .;•. Ar -so, <br />7-1 Dan River Basin r, <br />O Deep River Basin <br />You are also likely aware that Lee County <br />is located at the heart of "Deep River" oil <br />shale basin. <br />As such, staff has been monitoring the <br />Mining and Energy Commission and <br />related rulemaking activities over the past <br />couple of years in preparation for oil and <br />gas extraction activity in Lee County, <br />Sanford and/or Broadway. <br />Staff recognizes the need to make changes <br />to our Unified Development Ordinance <br />(UDO) to prepare for this land use <br />activity. <br />
